Rechtliche und ethische Fragen in Zusammenhang mit der Einführung der neuen Tarifstruktur SwissDRG in der Schweiz wurden bis heute nur in begrenztem Umfang untersucht und rechtliche sowie ethische Analysen dazu fehlen nahezu gänzlich. Das Buch befasst sich in einem ersten Teil mit den Veränderungen in der schweizerischen Spitallandschaft seit 1994 unter Berücksichtigung der aktuellsten Revision des Krankenversicherungsrechts im Jahr 2007 einschliesslich der Einführung des neuen pauschalisierten Tarifsystems SwissDRG für akutstationäre Spitalleistungen in der Schweiz. Da SwissDRG als ein wichtiger Bestandteil der neuen Spitalfinanzierung Auswirkungen auf besonders verletzliche Patientengruppen haben kann, untersucht der zweite Teil die Auswirkungen von SwissDRG auf diese Patientengruppen und zeigt Chancen und Risiken des neuen Tarifsystems sowie massgebliche Schutzbestimmungen in Form einer ethisch-rechtlichen Kriteriologie-Matrix auf. Das Buch beschränkt sich nicht auf die Analyse und die Beschreibung ethischer und rechtlicher Entwicklungen, die mit der Einführung des neuen Tarifsystems SwissDRG in der Schweiz verbunden sind, sondern trägt auch zu einer normativen Orientierung im Anwendungsbereich bei. Entsprechend umfasst der übergreifende Ansatz deskriptive und normative Anteile: Die Identifizierung ethischer und rechtlicher Fragestellungen im Bereich Auswirkungen von SwissDRG, die Analyse ethischer und rechtlicher Problemfelder im Bereich Auswirkungen von SwissDRG, die Bewertung verschiedener Handlungsmöglichkeiten zur Lösung von Problemen im genannten Bereich und die Umsetzung von begründeten Empfehlungen in der Praxis.

Im Krankenhausbereich erwiesen sich eine mangelhafte Pflegeversorgung, Wissensdefizite in der Behindertenmedizin und ein defizitärer Informationsaustausch zwischen den Akteuren als relevante Faktoren. Die Qualität der medizinischen Versorgung der Zielgruppe im Krankenhaus hat sich nach der DRG-Einführung zwar nicht verschlechtert. Gleichzeitig weisen die empirischen Daten aber auf eine versteckte Patientenselektion und Leistungsverlagerung der Krankenhäuser auf. Es sollten rechtzeitig geeignete Maßnahmen getroffen werden, um die Versorgungsprobleme zu entschärfen und gemeinwirtschaftlichen Kosten zu senken.
