La categoria dell’Einverleibung (incorporazione) lascia emergere una dottrina nella quale cellule, organismi, individui, popoli, civiltà, società e lo Stato stesso vengono sussunti nel modello dell’«organismo sociale», con cui Nietzsche riconfigura il rapporto tra il biologico e il politico sub specie corporis. L’Einverleibung non rappresenta, infatti, esclusivamente la legatura tra la seconda Unzeitgemässe Betrachtung del 1874 sino ai frammenti postumi del 1888, bensì un filosofema che emerge come riferimento nodale nel programma filosofico di Nietzsche: dal rapporto con il Biologismus-Debatte del XIX secolo alla presa di posizione all’interno del Darwinismus-Streit, dalla tensione tra individuazione e sociogenesi al superamento del paradigma sociologico, dall’istanza trasformativa dell’«eterno ritorno» sino all’idiosincrasia con la «verità ultima», dalla concezione dello Stato come fattore evolutivo alla configurazione politica dell’organismo, dalla coscienza come mediatrice tra sistema e ambiente sino a una prefigurata fisiologia della storia, l’incorporazione si manifesta come l’accadere fondamentale del principio universale della processualità ermeneutica della volontà di potenza.

La strada seguita dalla critica kantiana da un lato tende, anche nel suo percorso evolutivo, a fornire le condizioni e i limiti in cui l’esercizio della facoltà razionale si rende atto a legiferare sul terreno dell’interazione sociale e della costituzione di organismi istituzionali politici complessi. Si tratta del percorso che può essere definito cosmopolitico nel senso di una direzione che vede il declinarsi della domanda cosmologica sul terreno pragmatico della costituzione di un habitat concepito a misura d’uomo. Il cittadino del mondo è individuato come la figura di un soggetto attivo che si esercita nell’acquisizione di cognizioni e nello sviluppo di abilità, nonché nella costituzione di modelli di vita associata sempre più estese che conferiscano al globo terraqueo la forma di una polis. D’altra parte, però, l’interrogazione metafisica che anima nel profondo la ricerca critica di Kant, segna il convergere delle conoscenze e delle abilità umane verso un’idea di mondo, il cui ordine normativo-teleologico nessun organismo politico-istituzionale è in grado di «esibire in concreto». In questa prospettiva, l’uomo, in quanto ente razionale, si scopre parte di una comunità i cui fini trascendono lo spazio pragmatico in cui esercita il proprio arbitrio e il proprio potere, perché dell’esercizio dell’arbitrio e del potere essi individuano i limiti.

La comprensione della tecnica quale conquista ultima della metafisica moderna matura contestualmente alla critica all’umanismo della tradizione metafisica; al tempo stesso, la prospettiva del decentramento dell’umano emerge con sempre maggiore chiarezza a scapito di ogni residua concezione antropologico strumentale della tecnica. Tale visione critica d’insieme si inscrive nel più ampio quadro della nuova formulazione della Seinsfrage, nel quale la questione della tecnica si pone con la Kehre su base ontologica e non antropologica. Il ripensamento dell’essenza dell’umano a partire dalla differenza da altro, da un’alterità messa in questione, ha conseguenze considerevoli anche sull’ipotesi di riconsiderare la tecnica configurando proficuamente l’orizzonte oltre-umanistico. Accogliere l’invito a superare ogni antropologismo e soggettivismo nella convinzione che proprio in virtù di tale decentramento l'uomo non sia padrone degli enti che lo circondano appare uno snodo fondamentale, che è in grado di aprire prospettive nuove con cui potere ripensare il nostro futuro sul pianeta.

Nell’anno accademico 1937-38, Emilio Betti tenne un corso di lezioni in Germania. Il tema scelto dallo studioso per quelle lezioni era la storia costituzionale romana. Fu per lui un lavoro impegnativo: sia perché redatto e tenuto completamente in tedesco, sia perché consono all’orientamento del tutto storico-costituzionale della Antike Rechtsgeschichte allora in voga. La pubblicazione di questo lavoro (rimasto a lungo inedito) con traduzione in italiano a fronte dà risalto e conferma, contro consolidati pregiudizi, la particolare intensità con cui Betti viveva il momento storico. Soprattutto la parte riguardante il periodo pre-republicano e repubblicano (le prime 19 lezioni o, se si vuole, capitoli) mira ad aprire notevolmente, anche con riferimenti al pensiero greco ed a criteri teorico-interpretativi, l’orizzonte del lettore (allora ascoltatore) la prospettiva sociale ed economica caratterizzante il periodo considerato. Di particolare rilievo è anche l’impostazione didattica che, limitando all’indispensabile l’analisi delle fonti latine originarie (a suo tempo riservata alle ore di esercitazioni collegate), consente di seguire in modo agile e continuo il filo del discorso. Dunque un’esposizione di Storia del diritto romano che si rivela di notevole incisività anche sotto profili metodologici attuali.

Oaths play an essential part in the political and religious history of the West as a 'sacrament of power'. Yet despite numerous studies by linguists, anthropologists and historians of law and of religion, there exists no complete analysis of the oath which seeks to explain the strategic function that this phenomenon has performed at the intersection of law, religion and politics. The oath seems to define man himself as a political animal, but what is an oath and from where does it originate? Taking this question as its point of departure, Giorgio Agamben's book develops a pathbreaking 'archaeology' of the oath. Via a firsthand survey of Greek and Roman sources which shed light on the nexus of the oath with archaic legislation, acts of condemnation and the names of gods and blasphemy, Agamben recasts the birth of the oath as a decisive event of anthropogenesis, the process by which mankind became humanity.
