El cobro eficaz de los créditos adquiridos es una necesidad para todos los actores en el tráfico jurídico externo, ya sean profesionales o particulares, y adquiere especial trascendencia en el caso de las pequeñas y medianas empresas y de los consumidores. La mejora en el funcionamiento del mercado interior de la Unión Europea requiere agilizar la ejecución transfronteriza de deudas dinerarias. Más allá del Reglamento 1215/2012, sobre reconocimiento y ejecución de decisiones en materia civil y mercantil (Bruselas I bis), los llamados Reglamentos de “segunda generación” están diseñados específicamente para facilitar el cobro de estos créditos. Concretamente, se trata de los Reglamentos 805/2005, relativo al Título ejecutivo europeo para créditos no impugnados, 1896/2006 sobre el Proceso monitorio europeo, 861/2007 sobre el Proceso europeo de escasa cuantía y, más recientemente, el Reglamento 655/2014, sobre la Orden europea de retención de cuentas, cuyo uso es todavía muy limitado.Esta obra recoge los resultados del proyecto de investigación Informed Choices in Cross Border Enforcement (IC2BE) sobre la aplicación de los Reglamentos de segunda generación en España. Sin perder de vista el marco general del Reglamento de Bruselas I bis, además de dar cuenta de datos y razones sobre el uso de cada uno de ellos, la obra aporta estudios sobre sus respectivas características y problemáticas permitiendo una visión comparada de los mismos, así como sobre el modo en que el Derecho procesal interno se adapta para facilitar su aplicación por nuestros tribunales. Igualmente, se da cuenta de los medios con los que disponen las autoridades judiciales para hacer efectiva esta aplicación.El conjunto de estos trabajos permitirá a todos los operadores jurídicos profundizar en el conocimiento y manejo de los Reglamentos sirviendo, además, para adoptar decisiones informadas a la hora de elegir el procedimiento más adecuado con el fin de hacer efectivo el cobro de sus créditos monetarios.

En l se muestra que el proceso de integraci¢n europea no cuestiona la aplicaci¢n de la regla lex fori regit processum, sin embargo, repercute de forma cada vez mayor en la configuraci¢n del Derecho procesal interno aplicable no s¢lo respecto de los litigios surgidos en aplicaci¢n del Derecho comunitario, sino tambi n en aquellos resueltos conforme a normas puramente nacionales. As¡, la persecuci¢n de un £nico espacio europeo de justicia civil conduce a los Estados miembros, entre otras cosas, a aceptar sin controles la justicia impartida por las autoridades judiciales de cada uno de ellos de conformidad con sus propias normas procesales siempre y cuando stas satisfagan las garant¡as m¡nimas, previamente armonizadas, para la protecci¢n del derecho de defensa del demandado. Una vez logrado este paso, la necesidad de establecer procesos judiciales uniformes que, adem s, sean aplicables tanto a situaciones transfronterizas como internas, suscita cierta discusi¢n.

For the first time in the republican history of Peru, the presidential transition takes place in democracy, social peace, fast economic growth and favorable world markets. In other words, there has never been a better chance to build a different Peru - a richer country, more equal and governable. There are multiple ways to achieve that goal. New reforms must stem from a widespread and participatory debate, one of a common vision conceived for and by Peruvians. This book aims at making a technical and independent contribution to such debate; it summarizes the knowledge available about the challenges to be faced by the new administration. The study does not recommend silver bullets, but suggests policy options. It is based on the analysis of the current reality and in six decades of relationships with Peru, in which the Bank has implemented more than 100 projects and prepared more than 500 technical reports covering the wide range of development topics. When necessary, the study provides lessons that the Bank has learned elsewhere. The study provides a conceptual framework to the analysis of the country's 34 economic sectors and the two historical perspectives behind them.
