El presente documento que se deja a disposición de la comunidad académica, tiene como fin estudiar el control y bloque de constitucionalidad colombiano, para verificar su relación con el control de convencionalidad interamericano, a partir de la jurisprudencia de la Corte Interamericana de Derechos Humanos. En esta relación, se encuentra que la Carta Política colombiana es mucho más amplia que su texto constitucional, pues concurren otras disposiciones, contenidas en otros instrumentos o recopilaciones, que también son normas constitucionales, que concurren al texto dándole mayor volumen y alcance. Al respecto la Corte constitucional ha sido amplia en precisar que que las normas que integran el Bloque de Constitucionalidad tienen jerarquía constitucional, y, por tanto, son verdaderas fuentes de derecho que deben ser observadas por los jueces en sus providencias, pues su desconocimiento involucra violación a normas superiores; por tanto, su interpretación debe ceñirse a la dogmática y hermenéutica que le son propias. Así las cosas, el control de convencionalidad visto desde la perspectiva de la jurisprudencia y doctrina colombiana, tiene un fundamento jurídico interno en la Constitución Política, vía bloque de constitucionalidad, y otro fundado en el derecho internacional convencional, en la Convención de Viena de 1969 -de la cual Colombia es parte- en la denominada regla "Pacta Sunt Servanda" y en la obligación de los Estados pactantes de honrar sus compromisos internacionales, sin posibilidad de invocar disposiciones de su derecho interno, salvo lo dispuesto en el artículo 46 del mismo instrumento internacional. Por tanto, el control de constitucionalidad sobre normas jurídicas internas que reconozcan y regulen derechos humanos que no puedan ser limitados en estados de excepción, se ejerce atendiendo a lo dispuesto en los tratados internacionales ratificados por Colombia, lo cual necesariamente involucra al denominado "Control de Convencionalidad". Es así como el Estado colombiano tiene la obligación convencional de cumplir los tratados internacionales de los cuales sea parte, incluyendo los de derechos humanos, entre estos, la Convención Americana de Derechos Humanos, también conocida como Pacto de San José, y, por tanto, se constituye en garante de los derechos allí consagrados, tal como lo ha reconocido en reiterada jurisprudencia la Corte Interamericana de Derechos Humanos.

Since 2005 the carbon market has grown to a value of nearly $100 billion per annum. This new book examines all the main legal and policy issues which are raised by emissions trading and carbon finance. It covers not only the Kyoto Flexibility Mechanisms but also the regional emission trading scheme in the EU and emerging schemes in the US, Australia, and New Zealand. The Parties to the 1992 UN Framework Convention are in the process of negotiating a successor regime to the 1997 Kyoto Protocol whose first commitment period ends in 2012. This book grew from a series of lectures presented in 1983 in the context of the Summer Program in Phenomenology at The Pennsylvania State University. For these lectures I made use of notes and short essays which I had written between 1978 and 1982 during interdisciplinary seminars on Heidegger's later philosophy in general, and on his philosophy of language and art in particular. The participants in these seminars consisted of faculty members and graduate students concerned with the sciences, the arts, literature, literary criticism, art history, art education, and philosophy. On both occasions I made a special effort to introduce those who did not yet have a specialized knowledge of Heidegger's philosophy, to his later way of thinking. In this effort I was guided by the conviction that we, as a group, had to aim for accuracy, precision, clarity, faithfulness, and depth, while at the same time taking distance, comparing Heidegger's views with ideas of other philosophers and thinkers, and cultivat ing a proper sense of criticism. Over the years it has become clear to me that among professional philoso phers, literary critics, scholars concerned with art history and art education, and scientists from various disciplines, there are many who are particularly interested in "Heidegger's philosophy of art". I have also become convinced that many of these dedicated scholars often have difficulty in understanding Heidegger's lectures on art and art works. This is understandable.
