Should public opinion determine--or even influence--sentencing policy and practice? Should the punishment of criminal offenders reflect what the public regards as appropriate? These deceptively simple questions conceal complex theoretical and methodological challenges to the administration of punishment. In the West, politicians have often answered these questions in the affirmative; penal reforms have been justified with direct reference to the attitudes of the public. This is why the contention that politicians should bridge the gap between the public and criminal justice practice has widespread resonance. Criminal law scholars, for their part, have often been more reluctant to accept public input in penal practice, and some have even held that the idea of consulting public opinion constitutes a populist approach to punishment. The purpose of this book is to examine the moral significance of public opinion for penal theory and practice. For the first time in a single volume the editors, Jesper Ryberg and Julian V. Roberts, have assembled a number of respected criminologists, philosophers, and legal theorists to address the various aspects of why and how public opinion should be reflected in the way the criminal justice system deals with criminals. The chapters address the myriad complexities surrounding this issue by first weighing the justifications for incorporating public views into punishment practices and then considering the various ways this might be achieved through juries, prosecutors, restorative justice programs, and other means.

In Russia, as the confrontation over the constitutional distribution of authority raged, Boris Yeltsin's economic program regularly wended its way in and out of the Constitutional Court until Yeltsin finally suspended that court in the aftermath of his clash with the hard-line parliament. In Europe, French and German legislators and executives now routinely alter desired policies in response to or in anticipation of the pronouncements of constitutional courts. In Latin America and Africa, courts are--or will be-- important participants in ongoing efforts to establish constitutional rules and policies protect new or fragile democracies from the threats of military intervention, ethnic conflict, and revolution. This global expansion of judicial power, or judicialization of politics is accompanied by an increasing domination of negotiating or decision making arenas by quasi- judicial procedures. For better or for worse, the judicialization of politics has become one of the most significant trends of the end of the millenium. In this book, political scientists, legal scholars, and judges around the world trace the intellectual origins of this trend, describe its occurence--or lack of occurence--in specific nations, analyze the circumstances and conditions that promote or retard judicialization, and evaluate the phenomenon from a variety of intellectual and ideological perspectives.

In Is Shame Necessary? rising star Jennifer Jacquet shows that we have to use shame if we want to bring about political change and hold the powerful to account In cultures that champion the individual, guilt is seen as the cornerstone of conscience yet it proves impotent in the face of corrupt corporate policies. Jennifer Jacquet persuasively argues that modern-day shaming is a non-violent form of resistance that can be used to bring about large-scale change. Shaming, Jacquet shows, works best when used sparingly, but when applied in just the right way and at just the right time, it can keep us from failing ourselves.

Acclaimed scholar Kathryn Sikkink examines the important and controversial new trend of holding political leaders criminally accountable for human rights violations. Grawemeyer Award winner Kathryn Sikkink offers a landmark argument for human rights prosecutions as a powerful political tool. She shows how, in just three decades, state leaders in Latin America, Europe, and Africa have lost their immunity from any accountability for their human rights violations, becoming the subjects of highly publicized trials resulting in severe consequences. This shift is affecting the behavior of political leaders worldwide and may change the face of global politics as we know it. Drawing on extensive research and illuminating personal experience, Sikkink reveals how the stunning emergence of human rights prosecutions has come about; what effect it has had on democracy, conflict, and repression; and what it means for leaders and citizens everywhere, from Uruguay to the United States. The Justice Cascade is a vital read for anyone interested in the future of world politics and human rights.

Public Criminology written by Ian Loader and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-05-13 with Social Science categories.

What is the role and value of criminology in a democratic society? How do, and how should, its practitioners engage with politics and public policy? How can criminology find a voice in an agitated, insecure and intensely mediated world in which crime and punishment loom large in government agendas and public discourse? What collective good do we want criminological enquiry to promote? In addressing these questions, Ian Loader and Richard Sparks offer a sociological account of how criminologists understand their craft and position themselves in relation to social and political controversies about crime, whether as scientific experts, policy advisors, governmental players, social movement theorists, or lonely prophets. They examine the conditions under which these diverse commitments and affiliations arose, and gained or lost credibility and influence. This forms the basis for a timely articulation of the idea that criminology’s overarching public purpose is to contribute to a better politics of crime and its regulation. Public Criminology? offers an original and provocative account of the condition of, and prospects for, criminology which will be of interest not only to those who work in the fields of crime, security and punishment, but to anyone interested in the vexed relationship between social science, public policy and politics.
