Hablar de una nueva forma de esclavitud en estos tiempos puede resultar extraño. Sin embargo, la trata de seres humanos es eso. Bien claro lo dice el diccionario de la Real Academia: "Trata. Tráfico que consiste en vender seres humanos como esclavos". La trata de personas, conocida como la esclavitud del siglo XXI, atenta frontalmente contra los valores superiores de nuestro ordenamiento jurídico, poniendo en jaque un bien tan preciado como es el de la dignidad humana. Los avances legislativos realizados en la Lucha contra esta modalidad delincuencial en los últimos años son, sin duda, importantes, no sólo en cuanto a la investigación del delito y persecución de sus autores, sino, también, en cuanto a la detección, asistencia y protección de las víctimas. Puede decirse que los pilares que sustentan la prevención y lucha contra esta tipología delictiva, así como la protección de las víctimas en nuestro país, lo constituyen los arts. 177 bis CP, 59 bis de la LO 4/2000 -incorporado por LO 2/2009- y 140 y siguientes del Reglamento que desarrolla esta Ley, aprobado por RD 557/2011, incorporados a nuestro Derecho interno por así imponerlo diversas Directivas y Decisiones Marco del acervo comunitario. Es el estudio del artículo 177 bis del Código Penal el que aborda esta obra, la cual aparece dividida en dos partes. En la primera el autor lleva a cabo una aproximación al delito de trata de seres humanos con fines de explotación sexual, analizando inicialmente las diferencias que presenta el fenómeno respecto de otros con los que, en muchas ocasiones, mantiene una relación concursal, como es el tráfico e inmigración ilegal de personas y, por supuesto, la prostitución coactiva de las víctimas, objetivo último que buscan los "tratantes de personas". A continuación, hace un repaso cronológico de la distinta normativa española, comunitaria e internacional y aborda el estudio del concepto moderno de la trata. En una segunda parte realiza un análisis exhaustivo y riguroso del tipo penal previsto y sancionado en el artículo 177 bis del Código penal, cuando es con fin de explotación sexual, incorporado al Texto punitivo por virtud de la LO 5/2010 y reformado recientemente por la LO 1/2015, de 30 de marzo. Dedica, asimismo, un capitulo -el último- a las limitaciones penales y procesales en relación al principio de justicia universal de persecución extraterritorial y La problemática que plantea. Al analizar el precepto penal se ha apoyado en la doctrina más consolidada y en la jurisprudencia del Tribunal Supremo, así como en los pronunciamientos de los tribunales inferiores. Se incluyen las últimas sentencias de nuestro más Alto Tribunal: STS 861/2015, de 20 de diciembre, STS 178/2016, de 3 de marzo y STS 538/2016, de 17 de junio, esta última recogiendo ya el Acuerdo del Pleno no Jurisdiccional, de 31 de mayo de 2016, para la unificación de criterios, según el cual "El delito de trata de seres humanos definido en el artículo 177 bis del Código Penal, reformado por la LO 1/2015, de 30 de marzo, obliga a sancionar tantos delitos como víctimas, con arreglo a las normas que regulan el concurso real". Queda así resuelta la cuestión de si, siendo sujeto pasivo múltiple, debe entenderse cometido un único delito de trata de seres humanos o tantos como víctimas existan. La respuesta la da el Tribunal Supremo partiendo del carácter personalísimo del bien jurídico protegido: la dignidad humana.
