El Derecho penal de las “sociedades occidentales” está sufriendo desde hace algunos años transformaciones fundamentales: tanto la percepción social de la relevancia del delito y del ordenamiento penal como su utilización en los procesos políticos están cambiando. En este contexto, aún más después de los sucesos del 11 de septiembre de 2001, se aprecia la aparición de sectores de regulación (dirigidos a combatir la “criminalidad organizada” y, sobre todo, el terrorismo) en los que estos cambios político-criminales cristalizan en lo que Jakobs ha llamado “Derecho penal del enemigo”: normas jurídico-penales en las que ya no rigen principios de garantía y reglas de imputación que suelen postularse como elementos irrenunciables del trato de un Estado de Derecho con los infractores de preceptos penales. En la presente publicación, consecuencia de un intenso contacto entre los dos autores –que ejercen su actividad, respectivamente, en la Universidad de Bonn y en la Universidad Autónoma de Madrid–, se dan dos respuestas teóricas a este fenómeno común a los países de Europa occidental. Ambas aproximaciones intentan, de modo complementario, describir y encuadrar el fenómeno emergente del Derecho penal del enemigo en el edificio de la teoría del Derecho penal. Es en las consecuencias político-criminales en las que se manifiestan las discrepancias, en torno a cuál debe ser la respuesta adecuada frente al fenómeno: integrarlo de algún modo en el ordenamiento jurídico ordinario o expulsarlo fuera del Derecho penal para encuadrarlo, en su caso, dentro de las medidas de emergencia. Ningún jurista que de algún modo se ocupe del Derecho penal puede hoy eludir tomar posición sobre los cambios estructurales que vive la legislación penal de modo tan acelerado en la actualidad, y que son objeto de estudio en esta publicación en forma de diálogo intereuropeo. Esta segunda edición ha sido ampliada y actualizada con un texto de Jakobs referido al fenómeno del terrorismo y una nueva redacción de la contribución de Cancio Meliá, reflejando así una discusión científica incipiente pero intensa.
