¿Cuáles la función del derecho agrario en Colombia? Este ensayo se plantea dicha pregunta constantemente. El derecho agrario ha evolucionado desde la producción de alimentos y el acceso a la tierra de los campesinos -hacia la regulación de diversos actores en minería, agroindustria, turismo, servicios ambientales, energía, entre otros. El uso de la tierra y sus efectos sobre la sustentabilidad de los recursos naturales amplía el marco de intervención del derecho agrario hacia un derecho de tierras integral capaz de brindar respuestas al calentamiento global. El ensayo sostiene que el papel del Estado es arbitrar las conflictividades rurales. Es la aplicación de un derecho dinámico que imparte justicia en los territorios mediante la ponderación de las variables ambiental, social, económica y cultural. En el caso de Colombia, que busca superar un conflicto armado prolongado, es un derecho transicional de tierras que observa sus causas e impone correctivos diseñados por mecanismos transicionales para prevenir su reproducción y promover así la reconciliación local y nacional. El libro estudia la Resolución de la ONU (2018) que reconoció como sujetos de protección especial a los campesinos. Ilustra la histórica omisión del Estado y los riesgos de ineficacia en su papel regulador. Analiza los efectos del conflicto armado en los campesinos víctimas y el enfoque de justicia restaurativa que aplica el Sistema de Verdad, Justicia, Reparación y No Repetición. Plantea un modelo de reparación colectiva y simbólica que profundiza la paz territorial y el diálogo social iniciado por los Programas de Desarrollo con Enfoque Territorial (PDET) para que el derecho de tierras cumpla los objetivos de la justicia transicional.
