La evolución normativa de España desde la aprobación de la constitución en 1978 ha tenido que ser diligente en su adaptación a los dictámenes judiciales, particularmente en lo que respecta al estatuto jurídico de los profesores de religión, uno de los asuntos más disputados en el ámbito del Derecho Eclesiástico de nuestra democracia reciente. La configuración laboral de estos docentes ha sido moldeada a través de un sinfín de pronun-ciamientos judiciales. Si bien la Unión Europea (UE) ha mantenido una postura de no intervención en cuanto a la relación entre los Estados miembros y las confesiones religiosas, las tendencias más recientes en la jurisprudencia comunitaria han empezado a esbozar directrices significativas, particularmente en relación con la situación laboral de aquéllos. Estas corrientes emergentes justifican la imperiosa necesidad de reevaluar el estatuto jurídico de estos profesionales de la enseñanza en el momento actual. Una revisión que no solo responde a un imperativo legal, sino también a un compromiso con la equidad y la coherencia en el tratamiento de los derechos laborales en el seno de la Unión. Ya, que, aunque la UE no ha entrado a cuestionar el modelo de relación entre los Estados y las confesiones, las sentencias del TJUE, en lo que al régimen laboral de los profesores de religión se refiere, ha comenzado a marcar unas líneas de fuerza. Ésta es la principal razón por la que se hace fundamental revisar, hoy, el estatuto jurídico de los docentes de religión. Almudena Rodríguez Moya es doctora en Derecho y Profesora Titular de Universidad de Derecho eclesiástico del Estado en la UNED. Cursó sus estudios de doctorado en el Institut Catholique de Paris. Ha sido Investigadora senior en el Human Rights Law Centre – University of Nottingham. Durante los años de actividad profesional ha compaginado la docencia y la investigación con la gestión universitaria llegando a ocupar la Secretaría General de la Universidad Nacional de Educación a Distancia. Ha orientado su actividad investigadora al estudio de la libertad religiosa en un mundo globalizado junto con el análisis del pluralismo religioso en el ejercicio de la función pública y su reconocimiento en el derecho comparado y la jurisprudencia. Especializada en la protección de las creencias en la escuela, en la actualidad centra sus esfuerzos en buscar la mejora de la gestión de la diversidad religiosa en el ámbito educativo.
