Suele causar extrañeza presentar el estudio del arbitraje deinversiones junto con los derechos humanos; sin embargo, regímenes que en elpasado se veían sin punto de conexión hoy en día deben encontrarse para darrespuesta a nuevas realidades y buscar una armonización necesaria. La actual situación medioambiental y la posición del hombrefrente a ella nos demuestra que el recién reconocido derecho humano al medioambiente sano debe ser integrado con los demás derechos que regulan situacionesque lo afectan o podrán llegar a afectarlo. Entonces, la integracióncon el derecho de inversiones es inevitable. Mantener una visión aislada de los dos regímenes desconoceno solo la evolución del derecho, sino la urgente necesidad de proteger elmedio ambiente y, por ende, el derecho que todo ser humano tiene a gozar deeste de una manera sana. Por tanto, deben hallarse nuevos actores y nuevasformas de protección para lograr un equilibrio entre ambos.

"La relación entre el derecho internacional de la inversión extranjera (DIIE) y el derecho internacional de los derechos humanos (DIDH) ha sido tradicionalmente conflictiva. Sin embargo, la evidencia reciente muestra una creciente incorporación de elementos de DIDH en el DIIE. En ese contexto, este artículo estudia potenciales conflictos entre la obligación de brindar un trato justo y equitativo al inversionista extranjero bajo DIIE, y el derecho humano a un medio ambiente sano bajo el artículo 11 del Protocolo de San Salvador. Estos conflictos son analizados a la luz de una disputa inversionista-Estado surgida en Colombia, y se consideran diferentes posibilidades de armonización. Es un gusto presentar a la comunidad académica este nuevo libro de investigación que recoge los mejores trabajos de investigación discutidos en el tercer Congreso de Derecho Internacional, organizado anualmente por el Grupo de Investigación en Derecho Internacional de la Facultad de Jurisprudencia de la Universidad del Rosario y sus organizaciones aliadas.
