El presente libro analiza la creación del Ombudsman o Defensor del Pueblo en el derecho comparado. En el Capítulo I, se hace un estudio de los sistemas jurídicos de Suecia, Finlandia, Gran Bretaña, Francia y España, refiriéndose también a los orígenes históricos y al desarrollo de esta entidad en los países señalados. Además, se investiga la naturaleza jurídica de los Defensores del Pueblo en diversos ordenamientos jurídicos nacionales, así como sus competencias y funciones, con el propósito de ilustrar sobre la contribución del Ombudsman al perfeccionamiento de la democracia y el Estado de Derecho, especialmente a partir del establecimiento del Estado Social y Democrático de Derecho. El Capítulo II, se refiere a las Defensorías del Pueblo en el contexto latinoamericano y su aporte en relación a la protección de los derechos humanos. Asimismo, en la mayoría de los países de América Latina, los Defensores del Pueblo se inspiraron en los modelos de estas instituciones en Suecia, España y otras organizaciones internacionales. Por último, el Capítulo III se inicia con la descripción de ciertos organismos que aparecieron en la época colonial de Chile, aunque ninguno de ellos constituyó una base adecua-da para el concepto moderno del Ombudsman. Sin embargo, los proyectos legislativos para crear esta institución a nivel constitucional siguen pendientes desde 1990 en el Congreso Nacional. Es necesario establecer en el país un órgano independiente, como mecanismo de control extra-jurisdiccional que refuerce la capacidad institucional de los servicios públicos en beneficio de los ciudadanos.
