Con la aprobación de la Constitución de la República Bolivariana de Venezuela en el año 1999, se inicia una nueva etapa en la institucionalidad jurídico-política de la nación, al constituirse Venezuela en un Estado democrático y social de derecho y de justicia, consagrando dentro del Ordenamiento jurídico interno un catálogo amplísimo de Derechos y garantías, que pusieron a la vanguardia a Venezuela en cuanto a la protección constitucional y legal y de los Derechos Humanos. Consagrándose tal y como era necesario, el derecho al Debido proceso, también se incluyó el derecho la Tutela Judicial Efectiva, quedando establecido el artículo 26 de la Constitución. Estos derechos han venido desarrollándose a través de la Jurisprudencia de la Corte Interamericana de Derechos Humanos, y de las recomendaciones e informes emitidos por la Comisión Interamericana de Derechos Humanos, donde se han tratado con especial y obligada referencia, por ser ellos, pilares fundamentales del Sistema Universal de Protección de Derechos humanos, y constituir no solo derechos, sino también y al mismo tiempo Garantías básicas e insoslayables de todos los demás derechos consagrados en los ordenamientos jurídicos internos de cada país y en los diferentes instrumentos de protección. A lo largo de la corta historia de la Comisión Interamericana de Derechos Humanos, y de la Corte, se han podido detectar falencias en sus actuares, que lejos de propender a la protección y salvaguarda de los Derechos de los individuos, mas bien han reafirmado e incluso, en algunos casos, sellado, las violaciones estos derechos, trayendo consigo una dicotomía, que es imposible negar, y la cual es necesario erradicar a fin de lograr el efectivo respeto y protección de los Derechos Humanos a nivel Interamericano. En la presente investigación, abordaremos esta dicotomía evidente entre la función primordial de la corte y la actuación de la misma, que nace específicamente cuando es irrespetado por parte de la Comisión Interamericana de Derechos Humanos, el derecho que asiste a todo peticionario de obtener oportuna y pronta respuesta al asunto debatido. Aquí, Daniel Jesús Hernández Sarmiento y Francisco Javier Estaba, quieren dejar sentado que se trata de un análisis teórico acerca de este gran problema, y que al mismo tiempo al ser tratado con ejemplos prácticos, y al tomar como base datos jurisprudenciales para demostrar las hipótesis sostenidas, también, se proponen sus soluciones.
