El núcleo central de este trabajo se articula en base al estudio del art. 170 CC que regula la privación de la patria potestad. Se ha intentado aproximar una definición de la misma ante el silencio del legislador. Asimismo, se han concretado distintos aspectos de esta institución, a la luz de los postulados doctrinales y jurisprudenciales, que pueden crear cierta confusión Por otro lado, se procede a un estudio exhaustivo de sus causas, cuya naturaleza puede ser civil o penal. La falta de objetivación de las primeras, ha supuesto la existencia de pronunciamientos judiciales totalmente dispares e, incluso, antagónicos ante similares situaciones fácticas que son analizadas con profundidad.En relación a las causas de orden penal, es preciso señalar que las distintas modificaciones del Código penal han propiciado que la comisión de determinados delitos pueda suponer la privación de la patria potestad o la inhabilitación para su ejercicio, cuyos efectos son radicalmente distintos como se expone en el trabajo.Por último, se hace referencia a los efectos que la privación de la patria potestad provoca, siendo el más significativo, el relativo a la exclusión de las funciones parentales, aunque se mantienen ciertas obligaciones, como son velar por los hijos y alimentarlos, y el derecho a relacionarse con él. Se examinan, asimismo, las consecuencias que la privación de la patria potestad genera en el ámbito sucesorio, así como las producidas en sede de adopción.En la presente memoria se pretende realizar un juicio crítico sobre la regulación de esta figura, proponiendo soluciones legislativas para superar la problemática que presenta su aplicación práctica, que afecta de forma significativa a las relaciones paterno-filiales.
