El silencio es una figura enigmática rodeada del misterio que ofrece su ausencia de expresión y las múltiples explicaciones que subyacen tras él, entre lo que se supone que significa y lo que en realidad es. Por haber sido concebido de manera escasa, dubitativa e inconsistente, es necesario que se precise una valoración cierta sobre criterios objetivos en la experiencia dominicana y en la de muchas otras latitudes que comparten la misma incertidumbre. Ante la carencia de un concepto claro y de parámetros para definirlo, el recorrido de este libro de investigación iniciará con las formas en que el silencio se ha concebido tradicionalmente, para culminar con las que se proponen, por entenderlas adecuadas para descifrarlo, con la explicación previa de su con-cepto jurídico y del proceso para interpretarlo. En el caso particular del silencio contractual —considerado tipología del silencio jurídico—, este se da dentro del contexto de las relaciones entre partes, y su repercusión puede reflejarse al momento de la formación del contrato y duran-te su ejecución, para determinar si constituye o no una forma de manifestar la voluntad o, al contrario, ausencia de ella. Entonces, es necesario avanzar, de la libre apreciación del juez, hacia la determinación de los criterios objetivos para la interpretación del alcance jurídico del silencio, los cuales se proponen en esta obra para la definición de su concepto y valoración, con la finalidad de que no se encuentren sujetos a circunstancias particulares.
