Por ese motivo, es una de las figuras más cuestionadas y criticadas en nuestro país.Es así, debido a que el sobreseimiento provisional, nos muestra en muchas ocasiones, la ineficacia de la aplicación del Derecho Penal en el día a día, es decir, lo habitual es que no se proceda a la reapertura de una causa objeto de sobreseimiento provisional, creando cierta inseguridad jurídica, así como incertidumbre en el sujeto pasivo, inmerecidas.
