Durante los Tiempos Modernos en la Europa Occidental se asistió a una expansión de la ley penal y de los aparatos judiciales destinados a aplicarla. Descuartizamientos y mutilaciones con escarnio púbico y ejemplaridad, hasta lograr la muerte del condenado eran parte de lo narrado en la más duras sentencias. Foucault ha interpretado, a partir de estas narraciones, que los gobernantes absolutos, por medio de esos castigos, intentaban convertir a los súbditos, penados y espectadores, en cuerpos dóciles, gente con limitada capacidad para oponerse a los proyectos absolutistas y al avance de nuevas definiciones de propiedad. Ese sería un proceso de criminalización con impacto desigual en el tiempo y el espacio. Así, mientras en las ciudades parecía asentado en el siglo XVI, el los entornos rurales puedo llegar a ser tardío y tener concrecciones distintas a las esperadas por los gobernantes. La información ofrecida por cuatro millares de casos civiles y criminales de la cantabria rural de la época muestran una sociedad rural con códigos consuetudinarios de cooperación y de violencia tan fuertes que hacen insuficiente el esquema foucaultiano para explicar esa realidad. Conflictividad y Disciplinamiento Social refieren a dos escenas complementarias, es decir, al análisis de los conflictos y a las formas de resolución de los mismos, cualquiera que fuera su fuente, naturaleza y concreción. Examinar esas fuerzas articuladoras de la sociedad rural es el fin de este libro, colocando el foco de atención sobre el nudo que relacionaba a sociedad, justicia y, por medio de ésta, poder real.
