Seminar paper from the year 2005 in the subject Law - Media, Multimedia Law, Copyright, grade: 1,3, Bond University Australia, language: English, abstract: As technology develops and the use of computers continues to increase, businesses and people will enter into increasing numbers of contracts based more and more on electronic communications. Electronic commerce though is a broad term that encompasses electronic data interchange (EDI), on-line retailing, and electronic funds transfer (ETF) among other types of transactions. This paper is intended to discuss the need of a more detailed legislation for the Australian Electronic Transaction Act (Cth) 1999 (ETA) in relation to digital signatures. The Key question of this assignment is, if the details of an electronic signature framework should be specified by statute, left to regulation by administrative agencies or simply left to the marketplace. Firstly I will describe the different legislative approaches of jurisdictions around the world. Then I’ll have a closer look at the Australian ETA and try to classify them in one of the categories. An analysis of the ETA follows and I will point out the advantages and disadvantages of this Act. Following is a discussion about which legislative approach – explained earlier – is preferable and if there is need for a more detailed legislation for Australia. Furthermore the issues of trust and the rule of third parties in relation to digital signatures are debated. A very important issue in this context involves the allocation of liability and risk of persons using digital signatures, including certification authorities. At the end I recommend the most suitable approach for the Australian Federal Government.

In the past six years, more than 55 countries have begun adopting UNCITRAL's (United National Commission on International Trade Law) Model Laws of 1999 and 2001 regarding the use and validity of e-signatures. Dozens of pieces of legislation and legislative proposals now exist around the world on the subject of e-signatures. While the model laws may look the same on paper, in practice they can vary widely. Finally, you can be certain that your clients are in compliance when using digital signatures. The Center for International Legal Studies, in cooperation with UNCITRAL, has gathered experts in over 25 jurisdictions to analyze the impact of these standards in their respective domestic e-commerce regimes. These experts show how the Model Laws are actually implemented today in each of these countries. Now you can have on-the-ground feedback about how UNCITRAL's Uniform Rules on Electronic Signatures, the Model Law on Electronic Commerce 1996, and the Model Law on Electronic Signatures 2001 are being implemented. The Internet has lead to a revolution in how commerce is carried out. Whilst ecommerce is a new field of expertise, there are still general legal principles that apply to all transactions. This book looks at the changes for business brought about by ecommerce and the resulting legal framework. It examines legal issues that have to be addressed when making sales of goods over the Internet: contract law, contractual terms, capacity and authorisation, and trade practices. The Report explains the legal principles behind new ecommerce terms such as "shrinkwrap", "webwrap" and "cyberstuffing". It discusses terms such as "merchantable quality" and "s 52 of the TPA" in the context of ecommerce. The Report provides a current summary of case law developments in the ecommerce field as it applies to sales of goods and also looks at the implications of the legal principles to practical situations such as web site design, advertising, domain names, and linking and framing.
