The Law Library presents the complete text of the Endangered and Threatened Species - Delisting of the Eastern Distinct Population Segment of Steller Sea Lion under the Endangered Species Act (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 Under the authority of the Endangered Species Act of 1973, as amended (ESA), we, NMFS, issue this final rule to remove the eastern distinct population segment (DPS) of Steller sea lion (Eumetopias jubatus) from the List of Endangered and Threatened Wildlife. After receiving two petitions to delist this DPS, we completed a review of the status of the eastern DPS of Steller Sea Lion. Based on the information presented in the Status Review, the factors for delisting in section 4(a)(1) of the ESA, the recovery criteria in the 2008 Recovery Plan, the continuing efforts to protect the species, and information received during public comment and peer review, we have determined that this DPS has recovered and no longer meets the definition of an endangered or threatened species under the ESA: It is not in danger of extinction or likely to become so within the foreseeable future throughout all or a significant portion of its range. Thus, we find that the delisting of the DPS is warranted. This rule also makes technical changes that recodify existing regulatory provisions to remove special protections for the eastern DPS and clarify that existing regulatory protections for the western DPS of Steller sea lions continue to apply. "This environmental assessment/regulatory impact review provides decision-makers and the public with an evaluation of the environmental, social, and economic effects of alternatives to the Steller sea lion protection measures for the Bering Sea and Aleutian Islands Management Area groundfish fisheries, in particular the Atka mackerel and Pacific cod fisheries. The western distinct population segment (WDPS) of Steller sea lion is listed as endangered under the Endangered Species Act, and the species population in the Aleutian Islands is declining. Atka mackerel and Pacific cod are principal prey species for Steller sea lions in the Aleutian Islands. This proposed action would revise management of the Atka mackerel and Pacific cod fisheries to ensure the effects of these fisheries are not likely to result in jeopardy of extinction or adverse modification or destruction of critical habitat for the WDPS of Steller sea lions. This document addresses the requirements of the National Environmental Policy Act and Executive Order 12866"--Abstract.

"We, NMFS, have completed comprehensive status reviews under the Endangered Species Act (ESA) for seven foreign marine species in response to a petition to list those species. These seven species are the Eastern Taiwan Strait population of Indo-Pacific humpback dolphin (Sousa chinensis), dusky sea snake (Aipysurus fuscus), Banggai cardinalfish (Pterapogon kauderni), Harrisson's dogfish (Centrophorus harrissoni), and the corals Cantharellus noumeae, Siderastrea glynni, and Tubastraea floreana. We have determined that the Eastern Taiwan Strait Indo-Pacific humpback dolphin is not a distinct population segment and therefore does not warrant listing. We have determined that, based on the best scientific and commercial data available, and after taking into account efforts being made to protect the species, Pterapogon kauderni, and Centrophorus harrissoni meet the definition of a threatened species; and Aipysurus 2 fuscus, Cantharellus noumeae, Siderastrea glynni, and Tubastraea floreana meet the definition of an endangered species. Therefore, we propose to list these six species under the ESA. We are not proposing to designate critical habitat for any of the species proposed for listing, because the geographical areas occupied by these species are entirely outside U.S. jurisdiction, and we have not identified any unoccupied areas that are currently essential to the conservation of any of these species. We are soliciting comments on our proposals to list the six species. We are also proposing related administrative changes to our lists of threatened and endangered species.
