Excerpt from Energie und Recht: Eine Physikalisch-Juristische Studie Die in den folgenden Zeilen niedergelegten Betrach tungen verdanken ihren Ursprung der Anregung, welche durch den bekannten seit 1895 spielenden Streit uber die Korperlichkeit der Elektrizitat und uber die Anwendung des Begriffes Diebstahl auf die Elektrizitat gegeben wurde. Sie beschranken sich aber nicht auf die Rechtsverhaltnisse der Elektrizitat; diese erscheinen in ihr vielmehr als Nebensache, und die Kritik der Grundlage des Reichs gerichtsurteils vom 20. Oktober 1896 bildet nur eine kleine, allerdings unvermeidliche Episode. Die konsequente Betrachtung des Begriffes Verkehrswert fuhrt vielmehr erheblich uber das Gebiet der Elektrizitat hinaus und stellt an das Recht die Forderung, den Bereich seines vollen Schutzes in einem Sinne zu erweitern, der dem Gewinn des letzten Jahrhunderts an verscharften natur wissenschaftlichen Erkenntnissen entspricht.
