Unbundling lässt sich wortwörtlich mit Entflechtung übersetzen. Exakt besagt dieser Ausdruck, dass Energieversorgungsunternehmen den Geschäftsbereich Netzbetrieb von den Wettbewerbsbereichen Erzeugung und Vertrieb trennen müssen. Im Rahmen der Entflechtung werden vier "Unbundlingbereiche" definiert. Neben der organisatorischen ist die rechtliche, informatorische und buchhalterische Trennung des Netzbetriebs im Energiewirtschaftsgesetz (EnWG) geregelt. Da diese vier Bereiche in einigen Punkten interdependent sind, werden neben der operationellen Entflechtung die anderen drei Bereiche in dieser Arbeit auch gewisse Rollen einnehmen. Die Arbeit gliedert sich wie folgt: Den Beginn bildet ein kurzer Abriss über die Entstehungsgeschichte des Energiewirtschaftsgesetzes. Dem folgt ein komprimierter Blick auf die aktuelle Rechtsgrundlage und auf die allgemeinen Ziele des EnWG. Danach werden die genauen Ziele der Entflechtung und deren Erfordernisse beschrieben. Hierbei erfolgt auch eine Erläuterung über die rechtliche und informatorische Trennung des Netzbetriebs und deren Zusammenhang mit der operationellen Entflechtung. Nach den Ausführungen der Anforderungen des Gesetzes, werden erste Reaktionen der Energieversorger, sowie eine mögliche Strategie der Umsetzung der Erfordernisse dargestellt. Schließlich wird anhand des Beispieles "Vattenfall Europe" die Umsetzung der Entflechtungsvorschriften bei einem Energieversorgungsunterne

Inhaltsangabe:Einleitung: Bis zur Liberalisierung des europäischen Strom- und Gasmarktes im Jahre 1998 agierten Energieversorgungsunternehmen als Monopolisten mit unterschiedlichen Gesellschaftsstrukturen. Für den Kunden war ein Anbieterwechsel nicht möglich. Er musste seine Energie, von dem ihm zugeteilten Versorgungsunternehmen und zu einem vorgegebenen Preis beziehen, der sich kostenorientiert gestaltete und bei Tarifkunden von einer staatlichen Preisaufsicht genehmigt werden musste. Die Öffnung der Elektrizitäts- und Erdgasmärkte auf Grundlage der EU-Richtlinien von 1996 und 1998 hatte zum Ziel, die Effizienz im Energiesektor und die Wettbewerbsfähigkeit der europäischen Wirtschaft zu verbessern und letztlich auch den Preis für den Endkunden zu senken. Es hat sich jedoch im Laufe der Jahre gezeigt, dass die Struktur des deutschen liberalisierten Strom- und Gasmarktes nach wie vor nicht marktwirtschaftlich ausgerichtet ist. Die bis heute beibehaltene Wertschöpfungskette Erzeugung, Handel, Übertragung und Vertrieb in demselben vertikal integrierten Energieversorgungsunternehmen schafft den Unternehmen Anreize, ihre Monopolstellung gegen Wettbewerber weiterhin einzusetzen. Sie sind somit in der Lage, den funktionierenden Wettbewerb zum Nachteil fremder Netznutzer auf verschiedene Art und Weise zu stören und hemmen damit den Wettbewerb. Um dem entgegenzuwirken, haben das Europäische Parlament und der Rat der Europäischen Union neue Richtlinien über gemeinsame Vorschriften für den Elektrizitäts- und Erdgasbinnenmarkt (Beschleunigungsrichtlinien) erlassen. Sie fordern eine Trennung der einzelnen Geschäftsbereiche zum gesellschaftsrechtlichen, organisatorischen, buchhalterischen und informatorischen Unbundling. Hierdurch entstehen neue Unternehmenstypen, die sich unabhängig voneinander im Energiemarkt bewegen. Obwohl die wesentlichen Regelungsvorgaben zum Unbundling in der nationalen Umsetzung der Beschleunigungsrichtlinien - dem Zweiten Gesetz zur Neuregelung des Energiewirtschaftsrechts - festgelegt sind und diese ca. 95% der internen Unternehmensausrichtung umfassen, warten viele Energieversorger mit dem Beginn der Umsetzung dieser Vorschriften ab. This book results from a pioneering effort to organize a productive interdisciplinary research program on sustainable development policy in a small country not previously recognized as a world leader in environmental social science. The results are very promising, considering the short time frame and the high barriers to success for such an enterprise - differences in concepts and terminology, disciplinary myopia, and the inherent difficulty of the problem. In the USA, where I work, these barriers continue to pose major challenges after some 30 years of effort. Switzerland has made noteworthy progress in only five. I hope this book represents the beginning of a long term effort at problem-oriented interdisciplinary collaboration among Swiss researchers and prac titioners. The Swiss group has succeeded in developing a unifying framework that makes a major contri bution to environmental policy analysis. The framework broadens policy thinking by giving se rious treatment to underutilized strategies that rely on communication and informal influence as well as to well-studied ones that rely on technological change, regulation, and economic forces. This broad typology makes it easier for an analyst to escape the tendency to presume that the po licy instrument currently in fashion, whether it be market-based instruments, voluntary measures, or whatever, is the right strategy for all problems. It also encourages discipline-based analysts to consider how their favored strategies might be combined with other strategies less familiar to them, and thus to craft strategies that can take advantage of the strengths of various policy instruments.

Seminar paper from the year 2006 in the subject Politics - Topic: Globalization, Political Economics, grade: 1.5, The Australian National University, language: English, abstract: 1993 when Ruggie termed the ‘unbundling of territoriality’ was a year in which knowledge and communication that is its accessibility and dissemination entered a new realm of space and time. On the 30th of April 1993 the World Wide Web and its underlying technology was made freely available to use by anyone. Today over one billion people use the Internet, or every sixth person on the planet. A collective brain one might say is forming in front of our eyes growing with every new person entering three W’s into a web browser. While Ruggie aimed to search for, and investigate into, a fundamental transformation of the modern system of states, he emphasized that such an analysis would find a fruitful starting point in the [re]conceptualisation of territoriality. This paper will utilize Ruggie’s concept, by applying its analysis to the emerging and manifesting space-time implosion driven by the Internet and other communication technologies. Therefore, it is argued that Cyberspace provides a practical sphere to investigate into the unbundling of territoriality in a postmodern world. In the first section the impact on territoriality resulting from the emergence of the Cyberspace will be discussed. Ruggie’s model of differentiation between systems of rule and territory is applied to explain the transformation of territory in the postmodern era of Cyberspace. It is followed by an investigation into the consequences of Cyberspace on sovereignty. Showing that Cyberspace does indeed provide a new stage in Ruggie’s terms, facilitating an unbundling and relocation of sovereignty away from state territory. The third section discusses the implication of the virtual space on the rise and acceleration of globalisation. It is argued that globalisation, could not be perceived as a postmodern phenomenon without the Cyberspace revolution. The last part of the paper, proposes the need to rethink the notion of movement in the age of virtual and real spaces. Cyberspace allows ‘tourists’ in line with Bauman’s description to choose between virtual and real movement. The preceding discussion will finally lead to the conclusion that the conceptualisation of Cyberspace as one aspect responsible for the unbundling of territory provides an important explanatory insight into the transformation from modernity to postmodernity.
