A Organização Internacional do Trabalho (OIT) e seus órgãos vinculados, em 2016, estimaram que no mundo existem mais de quarenta milhões de pessoas submetidas ao trabalho escravo contemporâneo e práticas análogas. O Brasil, por sua vez, sendo a última nação da América do Sul a abolir a escravidão enquanto instituição formal e permitida, abriga cerca de 369 (trezentas e sessenta e nove) mil pessoas submetidas ao trabalho escravo contemporâneo em seu território, conforme índice endossado pela OIT em 2018. Nesse sentido, o Governo Brasileiro reconheceu a persistência do trabalho escravo em solo nacional frente aos organismos internacionais, adotando medidas para sua coibição. Entretanto, o Estado Brasileiro sofreu represálias perante a Organização dos Estados Americanos e o Sistema Interamericano de Direitos Humanos, ostentando, inclusive, recente condenação por responsabilidade internacional na Corte Interamericana de Direitos Humanos (CIDH), em virtude de flagrante omissão em graves denúncias de trabalho escravo. Desse modo, a presente pesquisa tem como tema geral analisar a escravidão contemporânea sob o viés da proteção dos Direitos Humanos. Em delimitação temática, o escopo do estudo constitui-se no trabalho análogo ao de escravo brasileiro, tanto abordando o cenário fático, quanto o entendimento jurídico-penal sobre o problema

O trabalho escravo contemporâneo, ou neoescravismo, deixou de ser apenas uma violação estritamente de cunho trabalhista e passou a significar também uma prática de violação dos direitos humanos, principalmente se tratando da maculação da dignidade humana e por expor o trabalhador a condições de trabalho degradantes, impactando negativamente na sua saúde física e mental, na qualidade de vida do trabalhador.
