A Organização Internacional do Trabalho (OIT) e seus órgãos vinculados, em 2016, estimaram que no mundo existem mais de quarenta milhões de pessoas submetidas ao trabalho escravo contemporâneo e práticas análogas. O Brasil, por sua vez, sendo a última nação da América do Sul a abolir a escravidão enquanto instituição formal e permitida, abriga cerca de 369 (trezentas e sessenta e nove) mil pessoas submetidas ao trabalho escravo contemporâneo em seu território, conforme índice endossado pela OIT em 2018. Nesse sentido, o Governo Brasileiro reconheceu a persistência do trabalho escravo em solo nacional frente aos organismos internacionais, adotando medidas para sua coibição. Entretanto, o Estado Brasileiro sofreu represálias perante a Organização dos Estados Americanos e o Sistema Interamericano de Direitos Humanos, ostentando, inclusive, recente condenação por responsabilidade internacional na Corte Interamericana de Direitos Humanos (CIDH), em virtude de flagrante omissão em graves denúncias de trabalho escravo. Desse modo, a presente pesquisa tem como tema geral analisar a escravidão contemporânea sob o viés da proteção dos Direitos Humanos. Em delimitação temática, o escopo do estudo constitui-se no trabalho análogo ao de escravo brasileiro, tanto abordando o cenário fático, quanto o entendimento jurídico-penal sobre o problema

O trabalho escravo contemporâneo (TEC) está inserido nas relações de trabalho entre as organizações e os trabalhadores, envolvendo práticas como: o cerceamento da liberdade, as condições degradantes de trabalho e a jornada exaustiva. O problema que deu azo a este livro foi: como ocorre o trabalho em condição degradante no Brasil rural? Possui como objetivo analisar as condições degradantes nas relações de trabalho do escravismo contemporâneo no campo. A problemática da escravidão contemporânea revela aspectos desastrosos da globalização, da produção de bens e serviços e do consumo da sociedade, estando presente nas mais diversas cadeiras produtivas. Através da análise dos acórdãos, foi possível identificar o perfil do trabalhador vulnerável e do empregador, as características do trabalho escravo contemporâneo e entender como ocorre a condição degradante de trabalho no meio rural. O trabalho escravo contemporâneo, ou neoescravismo, deixou de ser apenas uma violação estritamente de cunho trabalhista e passou a significar também uma prática de violação dos direitos humanos, principalmente se tratando da maculação da dignidade humana e por expor o trabalhador a condições de trabalho degradantes, impactando negativamente na sua saúde física e mental, na qualidade de vida do trabalhador.

This report is an account of contemporary forced labour to date. It provides the first global and regional estimates by an international organization of forced labour in the world today, including the number of people affected and how many of them are victims of trafficking, as well as of the profits made by the criminals exploiting trafficked workers.Based on these data, the report highlights the gravity of the problem of forced labour. From this data emerges three major categories of forced labour: forced labour imposed by the State for economic, political or other purposes, forced labour linked to poverty and discrimination and forced labour that arises from migration and trafficking of workers across the world, often associated with globalization.The report provides evidence that the abolition of forced labour represents a challenge for virtually every country in the world industrialized, transition and developing countries alike. It assesses experience at the national level in taking up this challenge, with particular emphasis on the importance of sound laws and policies and their rigorous enforcement, as well as effective prevention strategies. The report also reviews the actions against forced labour taken over the past four years by the ILO and its tripartite partners governments, employers and workers. It calls for a new global alliance to relegate forced labour to history.
