A relação entre Estado nacional e mercado é vista, muitas vezes, de maneira dicotomizada, como se cada um dos polos prejudicasse o outro. Acrescente-se que o neoliberalismo conduziu a uma nova configuração do mercado, agora globalizado, marcado e até dirigido por empresas transnacionais e multinacionais e pelo fluido capitalismo financeiro. A globalização, por sua vez, impôs questionamentos quanto à existência e à resistência do Estado nacional e impactos quanto ao próprio direito. Esta obra analisa a tensão entre Estado e mercado no contexto da globalização e do neoliberalismo, discutindo o papel do direito como medium, com enfoque no cenário brasileiro. Texto de contracapa: O Estado nacional, sob os influxos da globalização e do neoliberalismo, apesar de remodelado, permanece importante nos âmbitos interno e internacional, exercendo novos papéis, ligados à compensação das desigualdades sociais e à regulação, inclusive da economia. Por conseguinte, no contexto de sociedades complexas, plurais e globalizadas, o direito, editado e aplicado de acordo com a concepção procedimentalista, revela-se como instrumento para construção de uma coesão interna entre Estado nacional, mercado e sociedade civil, atuando como medium dessas relações. Destarte, é possível superar a dicotomia entre Estado e mercado e criar um ambiente de diálogo, inclusive, e sobretudo, com a sociedade civil. Essa é uma possibilidade para o caso brasileiro, em que, na edição e aplicação das leis, o Estado deve estar aberto às pretensões do mercado, mas sem subserviência, superando-se o capitalismo de laços, e sempre atento aos anseios da sociedade. O direito, assim, é meio de integração social e instrumento para o alcance dos objetivos fundamentais previstos no vigente texto constitucional.

Asistimos a una crisis de legitimidad de la política chilena.
