Tratar-se-á de um caso de violação de deveres pré-contratuais de informação: uma das partes engana a outra – intencionalmente ou não – ao transmitir-lhe informações incorrectas ou não cumprindo um dever de esclarecimento, omitindo informações essenciais à sua decisão. Daí que esta situação parece poder ser enquadrada na hipótese legal dos institutos da cic e dos vícios da vontade. Contudo, se não há dúvidas quanto à indução dolosa – que denominamos de dolo – há muitas relativamente à indução negligente.
