Antidiscrimination law is changing rapidly throughout Europe. It is moving from standard-setting to practical implementation. Pressed by civil society movements and international bodies tasked with monitoring equality, policy-makers are in search of new and more effective modes of combating discrimination and promoting equality. The issue of the processing of data relating to ethnicity and religion has become central to these developments. The availability of such data is recognized as playing an increasingly important role in the fight against discrimination. In order to elaborate policies designed to promote equality, States must be able to identify the nature and extent of discrimination, the groups affected by discrimination, and the fields in which discrimination occurs. To this end, they must have access to sufficiently precise information on the situation of members of vulnerable groups in the diverse fields of social life, such as employment, education or housing. In addition, the regular production of new statistical studies enables public authorities to monitor the implementation of equality policies and assess their impact. Private actors such as employers who aim to develop an equality plan in their company must have the means to assess the extent to which potentially discriminated groups are adequately represented in their workforce. Finally, the laws of several European Union member States allow the person who claims to be the victim of discrimination to have recourse to statistical data to prove indirect discrimination. However, in many European countries, the collection of data needed to fight racial and ethnic discrimination remains a matter of public controversy. And existing personal data protection legislation is often seen as an obstacle to the processing of such data, which international and European norms treat as highly sensitive. This book maps this debate, at a moment when it is emerging on continental Europe; and it seeks to move the debate forward. The authors explore to what extent and under which conditions the data needed to combat racial and ethnic discrimination can be collected, while fully respecting the rights of individuals. They clarify the implications of personal data protection under European law. Additionally, they discuss the issues raised by the construction of racial or ethnic categories, and by the choice of the criteria which will be relied upon to classify individuals into such categories. The analysis is based on international human rights law as well as on the laws and practices of several states. These various practices are reviewed in order to highlight the tensions and difficulties raised by the enterprise of classifying individuals into racial or ethnic categories for the purposes of anti-discrimination policies. The authors conclude that human rights standards, and in particular the right to privacy, do not preclude the collection of data on racial or ethnic origin for antidiscrimination purposes, although they define fundamental safeguards and limits that constrain the extent to and the manner in which this type of information can be gathered and processed.

This book addresses the legal feasibility of ethnic data collection and positive action for equality and anti-discrimination purposes, and considers how they could be used to promote the Roma minority’s inclusion in Europe. The book’s central aim is to research how a societal problem can be improved upon from a legal perspective. The controversy surrounding ethnic data collection and positive action severely limits their use at the national level. Accordingly, legal and political concerns are analysed and addressed in order to demonstrate that it is possible to collect such data and to implement such measures while fully respecting international and European human rights norms, provided that certain conditions are met. Part I focuses on ethnic data collection and explores the key rules and principles that govern it, the ways in which this equality tool could be used, and how potential obstacles might be overcome. It also identifies and addresses the specific challenges that arise when collecting ethnic data on the Roma minority in Europe. In turn, Part II explores positive action and the broad range of measures covered by the concept, before analysing the applicable international and European framework. It reviews the benefits and challenges of implementing positive action for Roma, identifies best practices, and gives special consideration to inter-cultural mediation in the advancement of Roma inclusion. The book concludes with an overview of the main findings on both topics and by identifying three essential elements that must be in place, in addition to full respect for the applicable legal rules, in order to combat discrimination and achieve the inclusion of Roma in Europe by complementing existing anti-discrimination frameworks with the collection of ethnic data and the implementation of positive action schemes.

This open access book examines the question of collecting and disseminating data on ethnicity and race in order to describe characteristics of ethnic and racial groups, identify factors of social and economic integration and implement policies to redress discrimination. It offers a global perspective on the issue by looking at race and ethnicity in a wide variety of historical, country-specific contexts, including Asia, Latin America, Europe, Oceania and North America. In addition, the book also includes analysis on the indigenous populations of the Americas. The book first offers comparative accounts of ethnic statistics. It compares and empirically tests two perspectives for understanding national ethnic enumeration practices in a global context based on national census questionnaires and population registration forms for over 200 countries between 1990 to 2006. Next, the book explores enumeration and identity politics with chapters that cover the debate on ethnic and racial statistics in France, ethnic and linguistic categories in Québec, Brazilian ethnoracial classification and affirmative action policies and the Hispanic/Latino identity and the United States census. The third, and final, part of the book examines measurement issues and competing claims. It explores such issues as the complexity of measuring diversity using Malaysia as an example, social inequalities and indigenous populations in Mexico and the demographic explosion of aboriginal populations in Canada from 1986 to 2006. Overall, the book sheds light on four main questions: should ethnic groups be counted, how should they be counted, who is and who is not counted and what are the political and economic incentives for counting. It will be of interest to all students of race, ethnicity, identity, and immigration. Colleges of further education in Great Britain have been involved in three recent initiatives in the implementation of ethnic monitoring: (1) a report on ethnic monitoring in postsecondary education; (2) two management training conferences on the implementation and uses of ethnic monitoring for representatives of further, adult, and higher education as well as local authorities; and (3) ethnic monitoring at the course level as the result of a more detailed study of how individual colleges use ethnic monitoring data to inform their internal planning and policymaking practices, improve the quality of services, and promote equal opportunities for ethnic minorities. Among potential benefits to be gained from introducing ethnic monitoring are that such monitoring facilitates: the collection of background data to use for future developments on equal opportunities; the ability of colleges to review provision and service delivery in the light of analysis of ethnic background information on their student body; and the drawing of comparisons across the years in the areas of services to minority groups. Ethnic monitoring has revealed that black students tend to enroll in low-level courses, Asian women are underrepresented in further and higher education, and there are differences in enrollment patterns between men and women. Key issues to evolve from ethnic monitoring at course level include the need for involvement of senior management, the importance of publication and dissemination of results, and the necessity of relating ethnic data to other information. In the European Union, discrimination based on racial and ethnic origin in the fields of employment, social protection, including social security and healthcare; social advantages, education and access to and supply of goods available to the public including housing is prohibited pursuant to the Racial Equality Directive (RED), which was adopted in 2000. The Charter of Fundamental Rights of the EU prohibits discrimination based - among other grounds - on race and ethnic origin (Article 21). The Council Framework Decision of 2008 sets out to combat certain forms and expressions of racism and xenophobia by means of criminal law. However, European law does not define these grounds. International and national law uses various terms in reference to racial and ethnic origin. The European Convention on human rights and fundamental freedoms (ECHR) prohibits discrimination based - among other grounds - on race, colour, language, religion, national or social origin and association with a national minority. The International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) prohibits racial discrimination, defining it as any distinction based on race, colour, descent, national or ethnic origin. All Member States have signed and ratified the ECHR and ICERD. Various international and national courts have interpreted ethnic origin broadly and national laws often define and list recognised ethnic minorities. Following the adoption and transposition of the RED, racial and ethnic minorities are now protected by anti-discrimination legislation across the Member States. The focus has turned to implementation and monitoring and in turn the need has arisen for data on (in)equalities based on racial and ethnic origin. Such data is essential to measure the level of implementation and monitor the impact of policies, but there are serious shortcomings as to data regarding the situation of racial and ethnic minorities. The common response in the country reports drafted for this project is that information is not collected on the grounds such as colour or racial origin. Data on ethnic origin and religion are collected on the basis of self-identification.
