Tenter de brosser un tableau général des principaux systèmes et droits pénaux, en droit de fond et en procédure, est l'objectif de ce Précis. Les législations sont cependant si hétérogènes et si changeantes que, conformément à une démarche habituelle en droit comparé, seules les grandes idées ont été ici décrites, quitte à ce qu'elles soient très souvent illustrées par des exemples précis. Et pourtant, cette diversité ne doit pas dissimuler une certaine unité entre droits et systèmes puisque les besoins sociaux sont souvent les mêmes. Sur la base de ces observations, l'ouvrage est divisé en deux parties. La première traite du droit pénal comparé général, c'est-à-dire des concepts communs à toutes les branches du droit pénal, qu'il s'agisse de ses sources formelles ou de ses principes directeurs. La seconde partie est consacrée au droit pénal comparé spécial. Plus technique et par conséquent plus approfondi, ce deuxième développement porte tour à tour sur l'infraction, sur le procès et sur la sanction. La nécessité d'études d'ensemble sur le droit pénal comparé a toujours été ressentie. Déjà Ortolan, en 1839-1841, avait écrit un Cours de législation pénale comparée. Mais, depuis lors, la doctrine, et pas seulement celle des pays francophones, s'était tue. Aujourd'hui, avec la montée de la criminalité, notamment de la criminalité sans frontières, un tableau du droit pénal comparé s'avère plus indispensable que jamais aux praticiens comme aux théoriciens.
