This volume compares and analyses the national civil services and the most important reform trends in the 27 Member States of the European Union. The principle of free movement of workers within the European Union is of great importance to the functioning of the internal market. As a result, exceptions to the fundamental principles of the European Union are kept to a minimum and are interpreted narrowly. One of the exceptions to the free movement of workers is the so-called 'public service' exception, which is laid down in Article 39 (4) (ex Article 48 (4)) of the EC Treaty. The main object of this book is to analyse this exception, both at the European level and the national level. In the first part of the book the author analyses in detail, the case law of the European Court of Justice dealing with the correct interpretation of the public service exception. Attention is also paid to the concepts of nationality and (European) citizenship. National legislation dealing with nationality requirements for employment in the public service in the Netherlands, Belgium and the United Kingdom are explored in the second part of the book. The book also offers a more general comparison of nationality requirements as they can be found in a number of other EU Member States. About the author: Jolanda Emmelien (Nanda) Beenen (1969) was born in Emmen, the Netherlands. She graduated in fiscal economics (1993) and Dutch law (1994) at the Erasmus University Rotterdam. She received an LL.M. from Cambridge University, Lucy Cavendish College, in the United Kingdom (1995). From 1996 to 2000 she held an Ph.D. research assistant post at the Netherlands Institute for Social and Economic Law (NISER), now the G.J. Wiarda Institute of Utrecht University. Since 1 December 2000 she is employed as a lawyer at the legal department of the Dutch Ministry of Agriculture, Nature Management and Fisheries.

EU Private Law and the CISG examines selected EU directives in the field of private law and their effects on the national private law systems of several EU Member States and discusses certain specific concepts of the United Nations Convention on Contracts for the International Sale of Goods (CISG) in light of the CISG’s recent fortieth anniversary. The most prominent influence of EU law on national private law systems is in the area of the law of obligations, thus the book focuses on several EU private law directives that cover the issues belonging to contract and tort law, as interpreted in the case law of the Court of Justice of the EU. EU private law concepts need to be interpreted autonomously and uniformly rather than through the lens of national private law systems. The same is true for the CISG which has not only been one of the most successful instruments of the international trade law unification but had also influenced both the EU private law and domestic laws. In Part I, focused on the EU private law and its effects for national laws, chapters examine the recent Digital Content and Services Directive and its likely impact on the contract law of the UK and Ireland, the role aggressive commercial practices play in EU banking and credit legislation, the applicability of the EU private international law rules to collective redress, the unfair contract terms regime of the Late Payment Directive and its transposition into Croatian law, the implementation of the Commercial Agency Directive in Denmark, Estonia and Germany, and disgorgement of profits as remedy provided in the Trade Secrets Directive. In Part II, dealing with selected CISG issues, chapters discuss the autonomous interpretation of CISG’s concept of sale by auction and its notion of intellectual property, as well as the CISG’s principle of freedom of form and the possibility for reservations with the effect of its exclusion. Over the last decades, the European Union has developed a series of ad hoc administrative procedures for the direct implementation of its rules in a number of areas - such as competition policy, trade policy, sate aids, access to EU documents, the EU civil service -, which resulted in a fragmented body of rules, whether in the form of law or soft law. The need to depart from this sector-specific approach to ensure consistent EU administrative procedures has therefore started to be debated in the academic sector as well as within the EU institutions. In this respect, following the entry into force of a new legal basis on administrative law introduced by the Lisbon Treaty the European Parliament has called for the adoption of a single European Administrative Procedure binding on its institutions, bodies, agency and offices including enforceable procedural rights for citizens when dealing with the Union's direct administration.
