Não há uma uniformidade quanto às razões que levam o legislador, prévia e abstratamente, a prever as técnicas diferenciadas de tutela dos direitos. Consagra-se, todavia, um direito fundamental ao procedimento adequado, corolário do devido processo legal e que garante a regulação adequada e adaptável do rito. As técnicas processuais levam em conta o direito em movimento no processo. Algumas principais razões são apontadas pela doutrina para justificar a previsão de procedimentos especiais e de técnicas diferenciadas. O objetivo é identificar se tais elementos justificam, ainda hoje, que a execução dos débitos inscritos em dívida ativa da União, Estados, Distrito Federal e Municípios seja feita pelo procedimento especial regulado pela lei n° 6.830/80. Na prática, os números mostram que a execução fiscal falhou miseravelmente. O rito especial é, de fato, o maior responsável pelo congestionamento do Judiciário brasileiro. Cabe aqui, portanto, perquirir as razões que justificam a previsão de ritos especiais como o da LEF, e se tais razões ainda permanecem. Para esta análise, debruçaremo-nos sobre a nova teoria dos procedimentos especiais, marcada por dois principais elementos: a alteração de foco dos procedimentos ou ritos às técnicas; a concepção do procedimento como flexível e adaptável. Este novo paradigma pode ser utilizado para uma releitura contemporânea da lei n° 6.830/80. Mais de trinta anos depois do início de sua vigência, identificaremos o que ainda pode ser extraído, em termos normativos, daquele texto.
