Riabchuk relativiert zugleich jedoch die Aussichten auf eine zügige Demokratisierung des postsowjetischen Landes. Diese Beurteilung deckt sich mit der bis heute aktuellen Einschätzung der Situation in der Ukraine, wie sie zum Beispiel in einer Agenturmeldung der Deutschen Presse-Agentur vom 27. April 2015 verbreitet wurde. Der EU-Ratspräsident Donald Tusk rief demzufolge die „krisengeschüttelte Ukraine zu dringend benötigten Reformen“ (dpa, 2015) auf. Jean-Claude Juncker betonte als Präsident der EU-Kommission, dass die Reformen schmerzhaft sein würden, aber insbesondere im Bereich der Korruptionsbekämpfung vorangetrieben werden müssten (vgl. ebd.). Auch zehn Jahre nach der Orangenen Revolution rangiert die Ukraine auf Platz 142 des Corruption Perception Indexes der nichtstaatlichen Organisation Transparency International – von 175 betrachteten Ländern (vgl. Transparency International, 2015). Trotz dieser offenbar stagnierenden Demokratisierungsentwicklung der Ukraine, schreibt Gerhard Simon der europäischen und nordamerikanischen Demokratieförderung dagegen eine gewisse positive Wirkung zu (vgl. Simon, 2009, S. 311). Vor diesem Hintergrund erscheint die Analyse der tatsächlichen Wirkung von durch externen Akteuren initiierten Maßnahmen zur Demokratisierung der Ukraine als wissenschaftlich relevant. Die Europäische Union (EU) ist einer der wesentlichen externen Akteure, die eine Demokratisierung der Ukraine unterstützen. Insbesondere die Förderung der Rechtsstaatlichkeit stellt dabei einen häufig betonten Schwerpunkt der EU-Maßnahmen zur Demokratieförderung in der Ukraine dar. In theoretische Hinsicht ergibt sich die Relevanz der Arbeit aus der mangelnden Verfügbarkeit von Studien zum Einfluss externer Demokratisierungsfaktoren in Bezug auf die Rechtsstaatsentwicklung in der Ukraine. In praktischer Hinsicht ergibt sich zudem die Möglichkeit einer Wirkungsanalyse der von der EU grundsätzlich umgesetzten Demokratisierungspolitik in EU-Nachbarstaaten, speziell bezogen auf den Erfolg der Maßnahmen in der Ukraine. Dabei ist es von Interesse in welcher Hinsicht erfolgreiche Ansätze in Zusammenhang mit den EU-Maßnahmen zu erkennen sind.

Ziel dieser Arbeit ist es, die Entwicklungen, Erwartungen und Problemfelder im Kontext der Europäischen Nachbarschaftspolitik auf dem Gebiet Rechtsstaatlichkeit aus ukrainischer Sicht zu untersuchen. Durch solch einen Perspektivwechsel soll ein Beitrag zur Debatte geleistet werden, wie europäische Akteure die Ukraine auf ihrem Weg zu rechtsstaatlichen Strukturen wirksamer als bisher unterstützen können. Die Struktur der Arbeit unterteilt sich in folgende Abschnitte: theoretische Grundlagen, rechtsstaatliche Reformen in der Ukraine, einem analytischen Teil sowie Zusammenfassung und Fazit. Das erste Kapitel dieser Arbeit gibt zunächst einen Überblick über die Grundlagen externer Demokratieförderung im Rahmen der ENP, samt ihrer Ziele, Instrumente, Mechanismen und Funktionslogiken. Anschließend wird auf Grundlage einschlägiger Sekundärliteratur die Rechtsstaatsproblemantik in der Ukraine kurz skizziert und der Reformprozess im Zeitraum von 2014 bis 2021 systematisch nachgezeichnet. Um die ukrainische Perspektive auf die externe Demokratieförderung der EU zu verstehen, werden im analytischen Teil dieser Arbeit exemplarisch drei wissenschaftliche Publikationen aus der Ukraine über den rechtsstaatlichen Integrationsprozess im Rahmen der Europäischen Nachbarschaftspolitik untersucht. Die zentralen Argumentationsmuster der Autoren werden analytisch herausgearbeitet und in drei wesentlichen Gesichtspunkten dargestellt. Schließlich werden in der Zusammenfassung die wichtigsten Erkenntnisse der Untersuchung nochmal festgehalten und die Forschungsfrage beantwortet.

The development of EU enlargement has raised many thorny issues unanticipated by the framers of the EC Treaty. A significant upshot of these issues is that the concept of European identity – defined in terms of such factors as culture, history and economics – has supplanted the long-dominant theme of ‘widening and deepening,’ particularly since the Union’s expansion has become primarily eastward. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the ‘identity’ conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between ‘widening’ and ‘deepening’ and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity. Also covered are specific historical details of particular pre-accession negotiations (e.g., Greece, Spain, Portugal, Malta, and Cyprus), the still inconclusive negotiations with Turkey and the Western Balkan states, and political factors involved in the non-accession of Norway, Iceland and Switzerland. Violent conflicts today are complex and increasingly protracted, involving more nonstate groups and regional and international actors. It is estimated that by 2030—the horizon set by the international community for achieving the Sustainable Development Goals—more than half of the world’s poor will be living in countries affected by high levels of violence. Information and communication technology, population movements, and climate change are also creating shared risks that must be managed at both national and international levels. Pathways for Peace is a joint United Nations†“World Bank Group study that originates from the conviction that the international community’s attention must urgently be refocused on prevention. A scaled-up system for preventive action would save between US$5 billion and US$70 billion per year, which could be reinvested in reducing poverty and improving the well-being of populations. The study aims to improve the way in which domestic development processes interact with security, diplomacy, mediation, and other efforts to prevent conflicts from becoming violent. It stresses the importance of grievances related to exclusion—from access to power, natural resources, security and justice, for example—that are at the root of many violent conflicts today. Based on a review of cases in which prevention has been successful, the study makes recommendations for countries facing emerging risks of violent conflict as well as for the international community. Development policies and programs must be a core part of preventive efforts; when risks are high or building up, inclusive solutions through dialogue, adapted macroeconomic policies, institutional reform, and redistributive policies are required. Inclusion is key, and preventive action needs to adopt a more people-centered approach that includes mainstreaming citizen engagement. Enhancing the participation of women and youth in decision making is fundamental to sustaining peace, as well as long-term policies to address the aspirations of women and young people.
