En pleno siglo XXI asistimos a un recrudecimiento de los conflictos socioambientales en el planeta, pese a la visibilidad que tiene el tema en el debate público y al grado de conciencia que han generado los movimientos ambientalistas. La creciente demanda global de minerales, petróleo y energía hizo que la explotación de recursos naturales se intensificara y que, como consecuencia, poblaciones enteras quedaran sumidas en la más cruda de las exclusiones: hombres, mujeres y niños, ahora enfermos y marginados, han perdido el acceso al agua, al alimento, a la vivienda. Este volumen, el primero de una serie editada por Dejusticia, vuelca la experiencia que los autores, destacados investigadores y activistas de los derechos humanos en el Sur Global, tuvieron en diversas zonas de conflicto (como la lucha que libran los pescadores tradicionales de Hobeni, en Sudáfrica; la extracción de hidrocarburos en el territorio guaraní ñandeva, en Paraguay; o la disputa por las tierras en la Sierra Nevada de Santa Marta, en Colombia). A partir de un estudio que combina el análisis académico, la vivencia personal, y una escritura que recupera la mejor de las tradiciones de la crónica narrativa y reflexiva, documentan el impacto de las economías extractivas sobre los derechos humanos y el medio ambiente en esos auténticos "campos minados"; es decir, regiones atravesadas por relaciones de poder profundamente desiguales entre intereses depredadores privados y comunidades locales, así como por la escasa presencia (cuando no la complicidad) del Estado, y donde la conflictividad y la violencia pueden estallar de un momento a otro. This Element analyses the political dynamics of neo-extractivism in Latin America. Una constatación evidente recorre hoy las experiencias políticas de países diversos: las herramientas democráticas y los instrumentos de derechos humanos –que han provocado avances innegables en la vida de millones de personas– resultan en gran medida insuficientes para evitar las formas extremas de marginación. En otras palabras, si bien los derechos humanos fueron fundamentales para visibilizar inequidades basadas en factores como el género y la identidad étnico-racial, está claro que coexisten con la permanencia de desigualdades socioeconómicas, y con el ascenso de populismos autoritarios que jaquean a las narrativas de derechos humanos en todo el mundo. Entre quienes señalan la incapacidad del activismo de los derechos humanos para conjurar la injusticia social, y quienes postulan la necesidad de separarlo del activismo de los demás derechos, este libro propone una postura intermedia: señala el trabajo de activistas, académicos y tribunales de países diversos que, con sus ideas y sus prácticas, muestran el potencial de los derechos humanos para resolver otras injusticias radicales y han contribuido a movimientos sociales más amplios contra la desigualdad y el mercado desregulado. Los autores y autoras de este libro son activistas-investigadores de organizaciones de derechos humanos de países muy disímiles y narran sus experiencias desde un ángulo geográfico y personal –el Sur Global, el relato "anfibio" entre la academia y el campo– que sitúa y enriquece sus miradas. In Struggles for the Human, Lara Montesinos Coleman blends ethnography, political philosophy, and critical theory to reorient debates on human rights through attention to understandings of legality, ethics, and humanity in anticapitalist and decolonial struggle. Drawing on her extensive involvement with grassroots social movements in Colombia, Coleman observes that mainstream expressions of human rights have become counterparts to capitalist violence, even as this discourse disavows capitalism’s deadly implications. She rejects claims that human rights are inherently tied to capitalism, liberalism, or colonialism, instead showing how human rights can be used to combat these forces. Coleman demonstrates that social justice struggles that are rooted in marginalized communities’ lived experiences can reframe human rights in order to challenge oppressive power structures and offer a blueprint for constructing alternative political economies. Extractivismo, empresas transnacionales y derechos humanos: en búsqueda de justicia es un trabajo en el que se propone una nueva estrategia de litigio para los casos de violaciones de derechos humanos ocurridos en Latinoamérica y que involucren a empresas transnacionales del sector extractivo (minería e hidrocarburos). Durante las últimas tres décadas, las industrias extractivas y los derechos indígenas se globalizaron de manera simultánea. Así, los conflictos relacionados con la explotación de los territorios indígenas se han hecho cada vez más frecuentes, violentos y extendidos en todo el mundo. En ese proceso, también se han "juridizado": cada vez más, las instituciones y el lenguaje jurídicos son protagonistas en los modos en que se formulan, procesan y resuelven esas disputas. Este cambio, que a primera vista puede parecer positivo, requiere una mirada más atenta y matizada. Ese es el objetivo de este libro, fruto de una investigación extensa, que reconstruye décadas de conflictos socioambientales en territorios nativos de América Latina con un foco original: el derecho de los pueblos indígenas a ser consultados antes de la realización de proyectos extractivos en sus territorios o de la adopción de normas que los afecten en forma directa. Recorre la figura jurídica internacional de la "consulta previa" –una institución surgida de la OIT en 1989– en los territorios indígenas del norte de Colombia en 2009 (donde el pueblo embera denunciaba no haber sido consultado antes de la construcción de la represa de Urrá, que dividió su territorio), en la zona de los incendios de la Amazonía brasileña en 2019 (donde el pueblo mundurukú había logrado detener la construcción de la represa que se planeaba sobre el río Tapajós, alegando la falta de consulta), y en la Amazonía ecuatoriana a mediados de la década de 2010 (donde el pueblo sarayaku lanzó una de las campañas globales más exitosas contra la explotación inconsulta de petróleo en territorios indígenas).

This book offers an in-depth analysis of a fundamental human freedom and a cornerstone of democracy: the Freedom of Religions or Beliefs (FoRB). The book focuses on the legal protection and promotion of FoRB in Europe because, in this context, exercising this right goes beyond a mere internal positioning in terms of legislation; rather, it is influenced by international and supranational case law, as well as the promotional activities of selected non-state subjects of international law. The content is divided into three sections: Part I on the European Convention of Human Rights, Part II on the EU, and Part III on other international actors. The first two Parts examine FoRB in its systematic aspects and “day-to-day” aspects. In contrast, the third Part highlights the promotional activities carried out by the Holy See, the ILO, the Council of Europe (“beyond the Strasbourg Court”), and the OSCE to promote, recommend or otherwise support it. Overall, the volume highlights how the exercise of FoRB can be ensured via international and supranational legal protection (both normative and judicial) and via promotional activities aimed at encouraging and helping states guarantee tolerance and pluralism in their national legislation.
