Intellectual property has a functional effect on the creation, development and innovation of the intellectual products which improve our life. The basic reason for protection of intellectual property rights is the necessity to encourage and support innovation and to promote the creation of knowledge. Software piracy is one of the important parts of the digital piracy problem and was also the first copyrighted product that was duplicated on a large scale. Definition of the reasons behind an existing problem is a crucial part of the problem solving process. With this study the factors behind the problem of pirated software usage will be empirically analyzed from the users' perspective by applying Routine Activity Theory (RAT). According to RAT, three major factors that affect criminal activities include access to suitable targets, motivated offenders and the absence of capable guardians. According to the routine activity approach, crime or the risk of crime increases when a motivated offender identifies or encounters a suitable target in the absence of a capable guardian.

Software piracy has been a problematic issue for several decades. While there is a significant body of research attempting to identify reasons why individuals pirate software, a complete understanding of the factors influencing software piracy has yet to emerge. Further, a concern with the results of software piracy studies reported by past researchers is the likelihood of social desirability bias. In the current research, two separate studies were conducted. In the first study, three antecedents (salience of ethicality, deterrence, and social influence) of software piracy behavior were examined in an experimental setting with actual money at stake. This allowed subject behavior to be observed rather than inferred from subject reports. In the second study, the behavior of subjects in one of the treatments of the first study was compared to subject self-report and peer-report responses to a hypothetical scenario that paralleled the experiment. For the self-report, the response was whether the subject would pirate. For the peer-report, the subject reported whether his/her peers would pirate. A comparison of behavior when money was at stake, to subject reports of likely behavior, helped examine the influence of social desirability bias in subject reports. Perceived salience of ethicality was significantly related to software piracy behavior in the experimental study, while perceived deterrence and perceived social influence were not. Self-report surveys exhibited high levels of social desirability bias. The peer-report survey method was found to exhibit far less social desirability bias, and provide a statistically equivalent piracy level as found in the experiment.

This book builds an empirical basis towards creating broader prevention and intervention programs in curbing digital piracy. It addresses the psychosocial, cultural and criminological factors associated with digital piracy to construct more efficient problem-solving mechanisms. Digital piracy including online piracy involves illegal copying of copyrighted materials. This practice costs the software industry, entertainment industry, and governments billions of dollars every year. Reports of the World Intellectual Property Organization (WIPO) and Business Software Alliance (BSA) view piracy largely in the light of economic factors; the assumption being that only those who cannot afford legitimate copies of software, music, and movies indulge in it. Drawing on research and theories from various disciplines like psychology, sociology, criminology, and law, the authors have designed an empirical study to understand the contribution of psychological, cultural and criminological factors to digital piracy. The chapters include data from India and China, which continue to be on the Special 301 report priority watch list of the WIPO, and Serbia, which has been on the watch list 4 times. They examine the role of self-control, self-efficacy, perceived punishment severity, awareness about digital piracy, peer influence, neutralization techniques, novelty seeking, pro-industry factors and other socio-demographic factors in predicting digital piracy. This book addresses a large readership, comprising academics and researchers in psychology, criminology and criminal justice, law and intellectual property rights, social sciences, and IT, as well as policymakers, to better understand and deal with the phenomenon of digital piracy.

Software piracy is the unauthorized copying, sharing, or using the software. It can be a profitable endeavor for individuals and a tremendous loss for the industry. According to Gulf News, Software piracy losses in the Arabian Gulf states in 2015 was 897 million dollars (AED 3.29 billion). Therefore, it is critical to understand as much as possible about the phenomenon and investigate the factors that influence subjects’ piracy behavior. Driven by gaps in previously published literature, the study presented here is an experimental investigation into the gender differences in identity-based social influence. In essence, the study examined if males or females are more likely to influence a group of their peers to either pirate or abstain from pirating a piece of software. While this topic is previously unstudied in the field of software piracy, it could be potentially useful in such areas as anti-piracy advertising. Further, as most of the published studies in software piracy are inclined to social desirability bias (as these studies traditionally rely on surveys and responses to paper-based scenarios), the study presented herein has been designed with the specific objective of avoiding social desirability bias by having real money at stake in an experimental setting.

Researchers have found that software piracy worldwide over the years has significantly contributed to billions of dollars in lost revenue for many software firms. Software developers have found it difficult to create software that is not easily copied, thus, creating a software protection problem. Software piracy remains a global problem despite the significant effort to combat its prevalence. Over the years, significant research has attempted to determine the factors that contribute to individuals' propensity to commit software piracy. Most of the research on software piracy has been limited to larger societies, with recommendations by researchers to extend similar studies to smaller ones. The literature indicating the need for additional research on this topic in different populations and cultures is significant. Given that, the key contributions of this study were to assess empirically factors such as personal moral obligation (PMO), cultural dimensions, ethical computer self-efficacy (ECSE) and the effect it has on individuals' propensity --- in cultures that support it --- to commit software piracy in smaller geographical locations. Therefore, this research empirically assessed the contribution that PMO, Hofstede's cultural dimension of individualism/collectivism (I/C), and ECSE have made on individuals' propensity to commit software piracy. The study extended the current body of knowledge by finding answers to three specific questions. First, this study sought to determine whether the PMO component contributed to individuals' propensity to commit software piracy in The Bahamas. Secondly, this study sought to determine the level of contribution of Hofstede's cultural dimension of I/C to individuals' propensity to commit software piracy in The Bahamas. Finally, this study sought to determine the contribution of ECSE to individuals' propensity to commit software piracy in The Bahamas.
