Praise and Reviews `An important new book.` African Review of Business and Technology Legal harmonization is an essential step to encouraging foreign investment in Africa and the development of sustainable pan-African trade. This important new book explains the new system of law, now being developed and promoted by OHADA. OHADA - the Organization for the Harmonization of Business Law in Africa - is an international organization currently comprising 16 Member States: Benin, Burkina Faso, Cameroon, Central African Republic, Chad, the Federal Islamic Republic of the Comoros, Congo, Côte d'Ivoire, Equatorial Guinea, Gabon, Guinea, Guinea-Bissau, Mali, Niger, Senegal and Togo. As a result of the creation of OHADA, business law in these African countries has recently entered a new era of rapid modernization and harmonization. OHADA's essential aim is to promote economic integration and development by creating a secure legal framework for the conduct of business in Africa. In order to achieve this aim, OHADA has enacted a number of laws, known as Uniform Acts, on various aspects of business law including commercial and company laws, insolvency, securities and arbitration. These Uniform Acts are directly applicable throughout the Member States. This book offers an overview of the aims and achievements of the OHADA system and explains in depth the legislation that has been issued to date. It will be invaluable to legal and business development executives in major global companies, international law firms, accountants and management consultants, students of international business law, government agencies, and NGOs concerned with Africa and African business people. Social Regionalism In The Global Economy written by Adelle Blackett and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2010-12-20 with Business & Economics categories.

Regional trade agreements have expanded exponentially over the past decade, and have become a significant, if controversial, factor in the expanse of economic globalization. Social Regionalism in the Global Economy attempts to take a fresh, interdisciplinary approach to addressing labour regulation by drawing upon insights from industrial relations, comparative capitalism, and new governance schools of thought. It stands for the proposition that an interdisciplinary study of regional regulation holds the potential to offer a fuller account of social regionalism. Its focus is to consider how institutions and labour market actors reconstruct and renegotiate regulatory space in a changing economic environment characterized by regional impulses. It argues that there is a dynamic interplay between institutions and actors of social regulation. This interplay occurs at many levels. The book therefore maps both how actors shape institutions as well as how institutions shape social actors’ ability to affect regulatory processes. The editors bring together leading international specialists willing to move beyond textual analyses of regional agreements to offer alternative accounts of regional integration. The work emphasizes that institutional context and social actors at multiple governance levels are integral to the progressive construction and regulation of regional space. It further contributes to the literature by combining insights from overlooked regional entities in transition and developing countries with original analyses from the European Union and the NAFTA. These aims will be achieved by combining original research that is empirically grounded with theoretically informed analysis.

International Labour Law written by Jean-Michel Servais and has been published by Kluwer Law International B.V. this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-04-24 with Law categories.

No one will deny that labour standards comprise a necessary framework for balanced economic and social development. Yet on a global level such balanced development has not occurred, despite the existence of a rigorous body of international labour law that has been active and growing for almost one hundred years. The implementation of this law devolves upon states; yet many states have failed to honour it. If we are to take serious steps toward a remedy for this situation, there is no better place to start than a thorough, well-researched survey and analysis of existing international labour law - its sources, its content, its historical development, and an informed consideration of the barriers to its full effectiveness. This book is exactly such a resource. It provides in-depth interpretation of the crucial International Labour Organisation (ILO) instruments - Constitution, conventions, declarations, resolutions, and recommendations - as well as such other sources of law as the OECD Guidelines for Multinational Enterprises and various model and actual corporate codes of conduct. Among the substantive areas of labour law covered in this book are the following: • the relationship between international labour law and economic competition • standards on industrial relations • collective bargaining and dispute settlement procedures • protection of trade unions • prohibitions on enforced and child labour • promotion of equal opportunity and treatment • time and rest provisions • wage determination and protection • occupational health and safety provisions • special issues on non-standard forms of employment • foreign and migrant workers • social security provisions • privacy protection The presentation demonstrates that these rules and standards offer invaluable benchmarks to governments, judiciaries, employers, and trade unions. The book's combination of detailed commentary and an overarching social policy will make it especially valuable to legislators, human resources managers, employers ́ organizations, trade unions, jurists, and academics concerned with the role of work in our globalized social system. This fifth edition of the book by Jean-Michel Servais analyses the potential of those standards in a globalized world, and the necessary evolution. It examines the actual implementation of those rules in the national context, comparing different experiences. It integrates the latest instruments. It examines the most recent public debates on labour regulation (dealing with health and security at work, personal data, minimum wages, social security, strikes, etc.), updates the bibliography and opens some perspectives for the future work of the global institutions.

The autonomous province of South Tyrol in Northern Italy is generally considered to be one of the most successful examples for the solution of ethnic conflicts. This book gives an analysis of the evolution of the legal instruments and institutions of self-government and minority protection through power-sharing as well as of the experience gathered during decades of the implementation of a "working economy." It thus provides insights regarding the state and the evolution of this specific case as well as for the general tendencies in the development of territorial autonomy and minority protection.

This book considers two interrelated core questions. The first is: how have legal philosophers systematized law, and what types of assumptions have they made in undertaking this task? Second, in what sense is law a system, and how is it maintained as such? In answering the first question thebook surveys and analyses the theories of a number of European legal philosophers and in answering the second puts forward its own distinct theory.

Crisis And Opportunity written by Francois Falloux and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-11-05 with Business & Economics categories.

Winner of the Prix Pierre Chauleur of the French Academie des Sciences d'Outre-Mer Until some way is found of dealing with Africa's catastrophic environmental crises none of the continent's other problems will find a long-term solution. Yet there is hope, and Crisis and Opportunity sets out a programme for dealing with the problems successfully. Written in a clear and engaging style, the book shows how environmental management can be achieved and institutionalized from within Africa, rather than through interference from the West, by implementing National Environmental Action Plans (NEAPS). Aware of the urgency of the problems, Francois Falloux and Lee Talbot offer practical guidelines based on direct experience and incorporate a great range of relevant case studies and examples. Their book will be of enormous importance to the governments, local communities and development agencies confronting the issues, and may mark a milestone if recovery in Africa is to take place. Francois Falloux is Senior Environmental Advisor, Africa Region at the World Bank. Dr Lee M Talbot is a former Director-General of the World Conservation Union (IUCN). Originally published in 1993
