Human and Minority Rights Protection by Multiple Diversity Governance provides a comprehensive overview and critical analysis of minority protection through national constitutional law and international law in Europe. Tradition und Verfahren stehen für zwei konträre Begriffe in der aktuellen philosophischen Diskussion. Insbesondere in der Ethik verweisen die beiden Begriffe auf eine in den letzten drei Jahrzehnten geführte Kontroverse über die Reichweite moralischer Geltungsansprüche. Kern des Streits ist die Frage, wie mit kulturellen Traditionen umzugehen ist. Sind Traditionen durch rationale Verfahren zu neutralisieren? Oder ist Tradition selbst eine Form von Rationalität, die erst zur Kritik der Moderne befähigt? In dieser Arbeit wird gezeigt, dass Tradition und Verfahren nicht zwangsläufig als konträre Begriffe verstanden werden müssen. Notwendig ist dazu ein Neuansatz in der Bestimmung des Traditionsbegriffs. Indem der Traditionsbegriff nicht über bestimmte Inhalte, sondern über die Handlung des Tradierens eingeführt wird, werden die Grundelemente einer rationalen Traditionstheorie sichtbar. Begriff und Theorie der Tradition münden so in den Entwurf einer Ethik als einer kritischen Kulturtheorie, in der Tradition zu einem unverzichtbaren Bestandteil diskursiver Verfahren wird.
