Die Arbeit untersucht die kollisionsrechtliche Behandlung der cohabitation legale des belgischen Rechts im deutschen Internationalen Privatrecht, wobei auch die verschiedenen Formen partnerschaftlichen Zusammenlebens und ihre sach- und kollisionsrechtliche Einordnung in Europa in den Blick genommen werden. Die Lösungen de lege lata werden kritisch hinterfragt. De lege ferenda wird für andere als durch Art.17b EGBGB erfasste Formen registrierten Zusammenlebens die Schaffung eines Art.17c EGBGB vorgeschlagen, in dem in erster Linie an den Aufenthaltsort angeknüpft wird, sodann an den Ort der Registrierung. Schließlich wird der Vorschlag einer europäischen Verordnung über das auf registrierte Partnerschaften und sonstige Formen registrierten Zusammenlebens anwendbare Recht formuliert.

Die Zahl internationaler Ehen und eingetragener Partnerschaften nimmt stetig zu. Nach welcher Rechtsordnung bestimmen sich aber deren vermogensrechtliche Beziehungen? Diese Frage ist auch fur den allgemeinen Rechtsverkehr von grosster Relevanz; denn gerade die nationalen Regeln uber das Aussenguterrecht divergieren stark. Zu bosen Uberraschungen konnen etwa auslandische Verfugungsbeschrankungen fuhren, an denen der Immobilienerwerb eines Dritten scheitern kann. Die Folge ist ein erheblicher Drittschutzbedarf auf kollisionsrechtlicher Ebene. Losungen sind kunftig auf Grundlage der seit dem 29. Januar 2019 geltenden Europaischen Guterrechtsverordnungen zu entwickeln. Stephan Graf widmet sich der Drittdimension der EuGuVO und der EuPartVO umfassend und bezieht dabei neben Gutglaubens- und Bestandsschutzproblemen u.a. auch das Verhaltnis zwischen Guter- und Sachenstatut sowie Fragen der internationalen gerichtlichen Zustandigkeit mit ein.
