Se trata, en esta obra, de analizar críticamente -a la luz de la Historia y con la ayuda de la doctrina- el aparentemente indubitado principio favor debitoris, poniendo de relieve como supuestos que, pretendidamente, giran en torno a él, son concreciones del mismo -elección en las obligaciones alternativas, no presunción de la solidaridad, modificación equitativa de la pena, nominalismo en las obligaciones pecuniarias, pago en el domicilio del deudor e imputación del pago-, pueden, a la postre y si bien se mira, explicarse prescindiendo del favor debitoris, en tanto que otros -el plazo como beneficio recíproco, la calidad media en las obligaciones genéricas, el posible pago de la parte líquida de la deuda- no consagran favor alguno, y otros más -pérdida del beneficio del plazo, solidaridad de créditos y deudas, genus numquam perit- llegan a inclinarse, se inclinan, en fin, por el principio contrario, del favor creditoris, todo lo cual lleva a concluir que el principio favor debitoris ha de ser sustituido por el de la protección de la parte más débil de la relación obligatoria derivada del contrato y, cuando tal debilidad no se aprecie, por el del exacto cumplimiento de los deberes derivados de la misma y el de la reciprocidad y equilibrio de las prestaciones, propio de las obligaciones sinalagmáticas, que son las más frecuentes en la vida cotidiana. El autor de la obra, Carlos Rogel Vide, es catedrático de Derecho civil de la Universidad Complutense de Madrid. Licenciado en Derecho por Santiago de Compostela con premio extraordinario, Doctor por Bolonia cum laude, investigador en La Sorbona, de la Academia de Iusprivatistas Europeos de Pavía, Árbitro de CIMA y de la OMPI, ha escrito, en materia de Obligaciones y Contratos, un manual con ese mismo título, dos monografías -La compraventa de cosa futura y La responsabilidad civil extracontractual- y numerosos artículos, relativos a los siguientes temas: concurrencia y prelación de créditos, valor jurídico del silencio, conclusión de los contratos, desistimiento unilateral, gastos de la compraventa, arbitraje, mediación y transacción, culpa y responsabilidad civil extracontractual de las personas sometidas a patria potestad, del fabricante, por productos defectuosos. O objetivo deste trabalho foi o de enfocar a posição do devedor na execução e sublinhar sua importância, estabelecendo um contraponto reputado necessário, nestes tempos em que o que mais se ouve falar é em um "processo civil de resultados" e "efetividade do processo". Essa tendência, cujos méritos não negamos, gerou uma espécie de "pensamento único", cuja característica é a de relegar claramente a segundo plano a posição do réu, olvidando a bilateralidade do direito de ação e o real sentido do princípio do devido processo legal. Para tanto, tecemos algumas considerações de ordem histórica acerca da posição do devedor, desde o direito romano até os dias atuais, fundamental para a compreensão do princípio do favor debitoris, que constitui propriamente o tema do trabalho. A seguir abordamos os princípios da dignidade humana, da razoabilidade, da proporcionalidade, da isonomia, e o da liberdade jurídica, todos informadores do princípio do favor debitoris. São examinados também as regras legais específicas decorrentes do mencionado princípio do favor debitoris, e que a importância deste no sistema, tudo com a intenção de ressaltar a existência de certos limites ao exercício do direito de crédito, que devem ser observados e prestigiados, sublinhando que este não pode ser exercido incondicionalmente.
