En la III Conferencia Mundial de la Mujer, celebrada 5 años después en Nairobi, se establece como prioridad la eliminación de la violencia contra la mujer y la familia en la sociedad. El paso entre ver a la mujer maltra. [...] define la discriminación contra la mujer y, que esa definición incluye la violencia basada en el sexo. Es decir, la violencia dirigida contra la mujer porque es mujer o que la afecta en forma desproporcionada. More than 600 women and girls have been murdered and more than 1,000 have disappeared in the Mexican state of Chihuahua since 1993. Violence against women has increased throughout Mexico and in other countries, including Argentina, Costa Rica, Guatemala, and Peru. Law enforcement officials have often failed or refused to undertake investigations and prosecutions, creating a climate of impunity for perpetrators and denying truth and justice to survivors of violence and victims’ relatives. Terrorizing Women is an impassioned yet rigorously analytical response to the escalation in violence against women in Latin America during the past two decades. It is part of a feminist effort to categorize violence rooted in gendered power structures as a violation of human rights. The analytical framework of feminicide is crucial to that effort, as the editors explain in their introduction. They define feminicide as gender-based violence that implicates both the state (directly or indirectly) and individual perpetrators. It is structural violence rooted in social, political, economic, and cultural inequalities. Terrorizing Women brings together essays by feminist and human rights activists, attorneys, and scholars from Latin America and the United States, as well as testimonios by relatives of women who were disappeared or murdered. In addition to investigating egregious violations of women’s human rights, the contributors consider feminicide in relation to neoliberal economic policies, the violent legacies of military regimes, and the sexual fetishization of women’s bodies. Focusing on femicide, this book provides a contemporary re-evaluation of Carol Smart’s innovative approach to the law question as first outlined in her ground-breaking book, Feminism and the Power of Law (Routledge 1989). Smart advocated turning to the legal domain not so much for demanding law reforms as construing it as a site on which to contest gender and more particularly, gendered constructions of women’s experiences. Over the last 30 to 40 years, feminist law scholars and activists have launched scathing trans-jurisdictional critiques of the operation of provocation defences in hundreds of femicide cases. The evidence unearthed by feminist scholars that these defences operate in profoundly sexed ways is unequivocal. Accordingly, femicide cases have become critically important sites for feminist engagement and intervention across numerous jurisdictions. Exploring an area of criminal law that was not one of Smart’s own focal concerns, this book both honours and extends Smart’s work by approaching femicide as a site of engagement and counter-discourse that calls into question hegemonic representations of gendered relationships. Femicide cases thus provide a way to continue the endlessly valuable discursive work Smart advocated and practised in other fields of law: both in articulating alternative accounts of gendered relationships and in challenging law’s power to disqualify women’s experiences of violence while privileging men’s feelings and rights.
