Agreement On The European Economic Area written by Finn Arnesen and has been published by Nomos/Hart this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-02-08 with Law categories.

The provisions of the Agreement on the European Economic Area (EEA) determine the relations of the EFTA countries Norway, Iceland and Liechtenstein with the EU and its Member States. On its basis, these three countries participate extensively in the internal market. The EEA is also discussed as a possible model for relations between the EU and the United Kingdom after Brexit. The new commentary, article by article, explores the importance of the legal practice agreement. It incorporates the extensive annexes and protocols to the agreement, which unlocks key secondary EEA law and establishes links with EU law. The current state of EEA law in Norway, Iceland and Liechtenstein is summarized by legislation and case law. The focus of the presentations lies in the commentary of the EEA regulations on the free movement of goods, the movement of persons, services and capital, transport policy and competition law. The tasks and procedures of the two EEA bodies European Surveillance Authority and EFTA Court, which are used for monitoring and dispute resolution, are explained by commenting on the EEA Regulations and the supplementary agreement concluded between Norway, Iceland and Liechtenstein. The work offers - A comprehensive overview of the special situation in Switzerland - Cross-sectional views on the effects of EEA law in Norway, Iceland and Liechtenstein and on the effects of EEA law in the EU - Important references to the international agreements accompanying the EEA - A comprehensive analysis of the changed legal environment, including the Treaty of Lisbon and other European Treaties. In addition, the commentary provides information on the current state of EEA law in the light of the case law of the EFTA Court and the legislation and case law of the three countries Norway, Iceland and Liechtenstein. For ease of use, the otherwise not easily accessible annexes and protocols, where relevant, and the supplementary agreements are printed.

The European Commission adopted its Digital Single Market Strategy in May 2015. Three years later, legislative measures are emerging which aim to tackle the unique legal problems arising from the supply of digital content and which will shape the development of national and European law in the future. The Digital Content Directive is set to play a central rule in this development. Its provisions on conformity and remedies for non-conforming digital content concern the heart of the protection for the consumer. Its rules will not only have to be transposed into national law over the coming years but will also interact with existing provisions from the Consumer Rights Directive 2011/83/EU, the E-Commerce Directive 2000/31/EU, and the Portability Regulation 2017/1128 in order for the legal framework on the supply of digital content to function. The Commentary contains an in-depth, article-by-article analysis of core provisions concerning the supply of digital content: from the pre-contractual information duties and cancellation rights to conformity and portability of digital content. The contributors are legal experts from across the EU. Their comments give not only detailed explanations of the background and purpose of the provisions in order to assist interpretation, but also indicate potential difficulties and solutions in order to ease transposition and implementation of the rules on the supply of digital content. It will be an essential guide for legislators, practitioners and scholars.

Waterborne transport is of crucial importance within the European Union. Almost 90% of the EU's external freight trade and 40% of the intra EU-exchanges of goods and passengers are carried by sea. 23 EU Member States are coastal states and 26 are Flag States. EU shipowners manage 30% of the world's vessels and 35% of the global shipping tonnage. Each year, more than 400 million passengers pass through European ports. The Framework of the 'Erika Packages' adds another regulatory level to the existing global legal regime. As a result, almost all aspects of maritime transport and shipping are now regulated by EU Law. Brussels Commentary on EU Maritime Law provides a comprehensive article-by-article analysis of the most relevant of these EU Regulations and EU Directives. The book covers the following issues: The EU and Maritime Transport: A Comprehensive Overview, Regulatory Issues in Shipping, Environmental Policy and Pollution Control, Maritime Safety, Maritime Security and Infrastructure, Consumer Protection and Passenger Rights, Carriage of Goods by Sea and Litigation, Market Access, Competition, State Aid, Maritime Labour and Working Conditions, The Regulation of Inland Waterway Transport. Comprehensive and authoritative, it is required reading for all practitioners in the field.
