Questo testo si presenta come tappa fondamentale nel percorso, che necessariamente dovremo affrontare, di decostruzione del mito irenico ed escatologico dell’Europa che dà la pace e la prosperità, di doloroso ma imprescindibile abbandono dell’europeismo del “dover essere” (come lo definisce Alfredo D’Attorre), di elaborazione di un lutto col quale dobbiamo fare rapidamente i conti, allo scopo di evitare che più gravi lutti vengano a turbare in modo irrimediabile il percorso comune dei popoli europei. Dalla Prefazione di Alberto Bagnai Un’informazione mediatica superficiale, non supportata dai dati, o comunque strumentalmente utilizzata, non manca di evidenziare, ciclicamente, l’inettitudine del popolo italiano quanto a utilizzazione dei fondi comunitari e sperpero di risorse economiche. Questo libro, che non è rivolto solo a giuristi ed economisti, ma a tutti gli italiani desiderosi di conoscere la verità, evidenzia una situazione completamente diversa: non solo i fondi comunitari sono utilizzati dall’Italia in una misura che è assolutamente in linea con gli altri Paesi dell’UE, ma qualunque analisi sull’utilizzo dei fondi non può prescindere da quella sugli effetti della contribuzione dell’Italia al bilancio UE (quale contributore netto) o dal contesto in cui operano detti fondi (un contesto esattamente delimitato dalle finalità principali stabilite nei Trattati). Partendo da questi aspetti e attraverso una puntuale disamina di molteplici fonti, scomode verità vengono alla luce: il sistema dei finanziamenti comunitari, per come strutturato, non può operare come sistema di trasferimenti compensativi (e quindi in un’ottica solidaristica) dalle aree con gli indicatori economici più “forti” a quelle più deboli, e si rivela, per contro, un esclusivo strumento di controllo da parte delle istituzioni UE, delle politiche economiche del Paese. Il sistema dei finanziamenti, inoltre, è tale che lo Stato membro è costretto a utilizzare (proprie) risorse in maniera del tutto svincolata dalle concrete necessità territoriali che, oltretutto, attraverso il sistema di cofinanziamento, aggrava ulteriormente la situazione di deficit di bilancio. Rimane deluso anche chi si aspetta di trovare in questo libro i dati sul raggiungimento degli obiettivi che con i fondi comunitari si sarebbero dovuti raggiungere negli anni scorsi: le stesse relazioni della Commissione UE o omettono di riportare dati concreti, oppure evidenziano un totale fallimento. With a Foreword by Kristalina Georgieva, European Commissioner for International Cooperation, Humanitarian Aid and Crisis Response Over the last decades natural and man-made disasters have been increasing in terms of frequency, size, number of people affected and material damage caused. There is growing awareness of the importance of adequate national and international legal frameworks for disaster prevention, mitigation and response. The implementation of these frameworks, however, poses serious challenges. This book analyses International Disaster Response Law as developed in recent times and identifies the main existing normative gaps. The authors address the rights and duties of States in preventing and mitigating disasters, in facilitating access to their territory for humanitarian relief actors, as well as issues related to liability and compensation. Due attention is paid to European Union law governing disaster response (and to its reform in the light of the Lisbon Treaty) and to the main trends in domestic legislation. Human rights obligations are thoroughly examined and the potential relevance of international criminal law is assessed. Additional topics such as the status of relief personnel, the hindrances to the delivery of relief consignments by customs and excise administration, the use of civilian and military defence assets in emergency situations, the mechanisms and procedures available to offer financial support for recovery and rehabilitation, risk insurance, and the issue of corruption during disaster-related activities are specifically addressed. By drawing on the expertise of lawyers, political scientists, economists and humanitarian practitioners, the book promotes much-needed interdisciplinary dialog and sheds light on a largely uncharted field of research. Work is constantly reshaped by technological progress. New ways of production are adopted, markets expand, and societies evolve. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Infringement proceedings constitute a signi¬ficant proportion of proceedings before the Court of Justice of the European Union and play a key role in the development of EU law. Their immediate purpose is to obtain a declaration that a Member State has, by its conduct, failed to ful¬l an obligation under the EU Treaties. The aim is to bring that conduct and its effects to an end and, ultimately, to eliminate infringements across the Union. This book – the ¬first comprehensive and detailed full-length work in English on infringement proceedings under Articles 258-260 TFEU – provides not only an in-depth discussion on the role and function of infringement proceedings within the EU legal order, but also a critical assessment of the procedures as they currently stand, complete with proposals for future changes.
