The success of a society depends on formal, liberal property regimes. The West's property regimes are successful because of the high quality of evidence of everyday rights, the capacity of citizenry and governments to implement the meaning of that evidence, and because the basic rules which determine what can be owned and who can be owners are liberal in measure appropriate to the common understanding of justice. Formalized property information feeds conflict resolution mechanisms by clearly identifying owners, claimants, rights and duties; creates stakeholders willing to support the rule of law; produces landowners who are less inclined to engage in illegal behavior because they risk forfeiture; and the records associated with formal property provide a powerful forensic tool with which to support peaceful conflict resolution processes, restitution programs, and bring violators to justice. Outside the lines of formal property lies possession by force. The gamut of societal choices is few - formal property, internal violence, or tyranny. People should not be led to choose tyranny over violence because the condition of formal property has not been offered. This book argues that the quality of foreign real-property systems be made a priority issue in US thinking and strategy. A polity that does not formalize ownership rights and duties, especially to land, will not enjoy peace. Comprehensive, precise and transparent expression of real property is a necessary precondition of peace. If by success of a society we mean parallel improvement in freedom, material prosperity and social peace, then construction of formal, liberal property regimes and land-use systems is as important as elections or prosecuting human rights violators. The process of formalizing property, moreover, illuminates power and power relationships. It also exposes the otherwise invisible lines of communication and sanctuary that power over places provides.

Millions of people all over the world have been displaced from their homes and property. Dispossessed individuals and communities often lose more than the physical structures they live in and their material belongings, they are also denied their dignity. These are dignity takings, and land dispossessions occurring in South Africa during colonialism and apartheid are quintessential examples. There have been numerous examples of dignity takings throughout the world, but South Africa stands apart because of its unique remedial efforts. The nation has attempted to move beyond the more common step of providing reparations (compensation for physical losses) to instead facilitating dignity restoration, which is a comprehensive remedy that seeks to restore property while also confronting the underlying dehumanization, infantilization, and political exclusion that enabled the injustice. Dignity restoration is the fusion of reparations with restorative justice. In We Want What's Ours, Bernadette Atuahenes detailed research and interviews with over one hundred and fifty South Africans who participated in the nations land restitution program provide a snapshot of South Africas successes and failures in achieving dignity restoration. We Want What's Ours is globally relevant because dignity takings have happened all around the world and throughout history: the Nazi confiscation of property from Jews during World War II; the Hutu taking of property from Tutsis during the Rwandan genocide; the widespread commandeering of native peoples property across the globe; and Saddam Husseins seizing of property from the Kurds and others in Iraq are but a few examples. In his remarkable, path-breaking new book, Peter Sparkes takes stock of the development of a distinctive body of European land law, taking as his starting point the idea that methods of land-holding permitted by a legal system both shape and reflect the attitudes of the land owners and society in general. However it quickly becomes very difficult to test that idea when the society in question is governed by an internal market composed of 30 countries (the EU-27, including Bulgaria and Romania, and the EEA-3), whose property systems differ so markedly and which reflect such widely differing cultures. Yet the internal market has already effected a gradual equalisation and standardisation across Europe as foreign capital spreads to create equality of yield. "We all become better off by joining a larger trading block but the social consequences will be profound: Brits will need to emigrate to the continent to afford a home, Bulgarians will need to make way for them along the Black Sea coast, and title deeds will be reshuffled all over Europe on a giant Monopoly board" writes the author in his preface, before embarking on a dispassionate examination of the beginning of that process of profound change. The opening chapters are devoted to an explanation of how the internal market has created a substantive European land law. Chapter 3 examines the rise of a distinctive European land law, and the development of conflicts principles applying to recovery of land. Chapters 5 to 9 on the marketing and sale of land focus upon Community competence on consumer protection. The decision to treat land as a product like any other in the Unfair Commercial Practices Directive will have wide ranging and far reaching implications and, apart from marketing of land and of timeshares, other chapters deal with conveyancing, contracting and the emerging market in mortgage credit. The book concludes with a miscellany of conflicts rules which are gradually coalescing and form the elements from which a substantive European land law can be forged. A number of topics which it is not possible to cover in detail (VAT, other taxes, environmental controls and agriculture) are touched on briefly, and the same is true of international aspects of trusts and succession.
