Excerpt from Forschungen zur Reichs-und Rechtsgeschichte Italiens, Vol. 1 Ware es mir damals moglich gewesen, jenen Aufsatz sogleich dmckferfig zu machen., so wurde ich mich schwerlich mit diesen Dingen weiter beschaftigt haben. Da ich mich genothigt sah, den Entwurf bis zum Ende des Studien jahres liegen zu lassen, war es naturlich, dass ich in der Zwischenzeit wenig stens auf alles achtete, was mit jenem Gegenstande naher zusammenhing, aus nachstliegenden Hulfsmitteln mein Material zu mehren suchte damit mich aber auch mehr und mehr uberzeugte, dass manche meiner ersten Annahmen sich doch einer genaueren Prufung der Zeugnisse gegenuber nicht halten liess, dass mancher N ebenpunkt wenigstens einer oberflachlichen Erorterung durchaus bedurfe, sollte das Ergebniss des Hauptpunktes auch nur vorlaufig irgend be friedigen. Wenn ich mich dadurch nicht bestimmen liess den Gegenstand uberhaupt ganz fallen zu lassen, wenn ich sogleich nach Schluss des Studien jahres begann, den Aufsatz auf etwas erweiterter Grundlage umzuarbeiten, so dachte ich freilich an nichts weniger, als dass diese Sachen mich jahrelang beschaftigen wurden. Wenn das so gekommen ist, so lag der Grund vorzug lich darin, dass es sich bei diesem Gegenstande nicht darum handelte, auf einem im allgemeinen genugsam bekannten Gebiete nur einen einzelnen, bisher nicht beachteten oder meiner Ansicht nach nicht richtig gewurdigten Punkt zu erortern. So konnte sich die Sache allerdings darstellen, wenn ich, wie das zunachst der Fall war vom Gebiete des genugender bekannten deutschen Gerichtswesens ausging, nachzuweisen suchte, wie hier ausnahmsweise die ab weichende italienische Form der Urtheilsfallung wohl schon fruher eingewirkt haben konne nur das war mir erster Anlass, gerade diesen Einzelpunkt auf zugreifen. Sobald es nun aber galt, Bestehen und Entstehen jener Form in Italien genauer nachzuweisen, war das Verhaltniss ein durchaus anderes; es handelte sich nicht mehr blos um einen einzelnen bisher unbeachteten Punkt.
