Ernst-Wolfgang Böckenförde (b. 1930) is one of Europe's foremost legal scholars and political thinkers. As a scholar of constitutional law and a judge on Germany's Federal Constitutional Court (December 1983 - May 1996), Böckenförde has been a major contributor to contemporary debates in legal and political theory, to the conceptual framework of the modern state and its presuppositions, and to contested political and ethical problems. Thus, his writings have shaped not only academic but also wider public debates from the 1950s to the present, to an extent that few European scholars can match. As a federal constitutional judge and holder of one the most important and most trusted public offices, Böckenförde has influenced the way in which academics and citizens think about law and politics. During his tenure as a member of the Second Senate of the Federal Constitutional Court, several path-breaking decisions for the Federal Republic of Germany were handed down, including decisions pertaining to the deployment of missiles, the law on political parties, the regulation of abortion, and the process of European integration. This book examines a selection of themes that have become salient in contemporary debates on constitutional democracies. It focuses in particular on the experiences of India and Germany as examples of post-war and post-colonial constitutional democracies whose trajectories illustrate democratic transitions and transformative constitutionalism. While transformative constitutionalism has come to be associated specifically with the post-apartheid experience in South Africa, this book uses the transformative as an analytical framework to transcend the dichotomy of west and east and explore how temporally coincident constitutions have sought to install constitutional democracies by breaking with the past. While the constitution-making processes in the two countries were specific to their political contexts, the constitutional promises and futures converged. In this context, the book explores the themes of Constitutionalism, Nationalism, Secularism, Sovereignty and Rule of Law, Freedoms and Rights, to investigate how the contestations over democratic transitions and democratic futures have unfolded in the two democracies. It offers readers valuable insights into how the normative frameworks of constitutional democracy take concrete form at specific sites of democratic and constitutional imagination in Dalit and Islamic writings, as well as the relationship between state and religion in the writings of public intellectuals, political and legal philosophers. English summary: The republican principle was regularly viewed in legal scholarship as especially precarious, and based upon that view, a singular article in a negative sense. On the other hand, this present investigation is based on the assumption that even the contrary perception of the republic as a normal constitutional principle offers an innovative perspective that is able to concretize and grasp the fundamental, constitutionally generative choices and their normative structures, in a manner that is more compatible with legal scholarship. The commonplace nature of the republican principle as a working hypothesis makes possible a repatriation of the republic and the jurisprudential conflicts with it in the current discourse over the juridical development of constitutional principles. This method also illustrates, moreover, the potential of the republican principle as an ordinal idea for the evolving legislative community of domestic, supranational and international law. German description: Das Republikprinzip wird in der Rechtswissenschaft regelmassig als eine besonders prekare und vor diesem Hintergrund in einem negativen Sinne singulare Bestimmung des Verfassungsrechts angesehen. Demgegenuber basiert die vorliegende Untersuchung auf der Annahme, dass gerade die entgegengesetzte Wahrnehmung der Republik als ein normales Verfassungsprinzip eine geeignete Ausgangsperspektive darstellt, um diese verfassungsgestaltende Grundentscheidung in rechtswissenschaftlich anschlussfahiger Weise inhaltlich konkretisieren und normstrukturell erfassen zu konnen. Die Normalitat des Republikprinzips als Arbeitshypothese ermoglicht eine Ruckfuhrung der Republik und der rechtswissenschaftlichen Auseinandersetzung mit ihr in die allgemeinen Diskurse uber die juristische Erschliessung von Verfassungsprinzipien. Der Prozess der europäischen Integration stellt die Kirchen Europas vor neuartige Herausforderungen. Durch wirtschaftliche, gesellschaftliche und rechtliche Regelungen werden Standards geschaffen, die eine neue Umwelt für die Kirchen als religiöse Organisationen bilden. Dabei stehen die Kirchen nicht nur vor der dem Problem unterschiedlicher Strukturen und theologischer Differenzen, sondern auch vor der Aufgabe sich zu den anderen Religionen und zur Europäischen Union als Staatsgebilde verhalten zu müssen. Die Autorin nimmt sich dieser Problemstellung mithilfe von empirisch-sozialwissenschaftlichen, historischen und theologischen Verfahrensweisen an. Die Eröffnungsfrage nach der Identität Europas wird im Diskurs zwischen Selbstverständnissen, institutionell-ideologischen Strukturen und historischen Konzepten erörtert. Darauf folgt die Einordnung der Kirchen und weltanschaulichen Gemeinschaften in den Kontext europäischer Zivilgesellschaft. Die Erörterung der Europakonzepte des Islams, der russischen Orthodoxie, des römischen Katholizismus und der evangelischen Kirchen bildet den Hintergrund für die Konzeption einer kulturprotestantisch orientierten protestantischen Ekklesiologie im europäischen Horizont.
