El autor de este libro trata de dilucidar si todas las fuentes que figuran en los elencos de Pomponio, Gayo y Papiniano entran o no en la categoría de «creadoras». Significa, a este respecto, que la obra de creación jurídica, de establecimiento de normas asistidas de «legitimidad», responde en Roma a una constante histórica: la de que el Derecho es fruto de quehacer comunal, a partir de creencias anidadas en sacrosanto pretérito. Se explica el escaso intervencionismo de los órganos estatales en el campo del Derecho privado por la lisa y llana razón de que éste viene timbrado por principios ungidos en la más vieja hora como Derecho eminentemente «familiar». El tradicionalismo hace de la familia eje y centro de las determinaciones judiciales. Sin embargo, pese a la firmeza de lo real legal, de la norma civil eterna, con sus límites o cortapisas a las actuaciones jurisprudencial y pretoria, la infiltración de lo «creativo», por sutil obra de éstas, resulta evidente.
