En la actual crisis del mundo globalizado y de nuestro país, sobre todo por los efectos del aumento sustancial de la desigualdad, el derecho del trabajo tan criticado como rigidez anti mercado en las últimas décadas ha vuelto a tener protagonismo. Este derecho centenario, con su vocación protectora y reequilibradora del poder, se perfila como un elemento insustituible para un capitalismo moderado, que permita redistribuir el ingreso y asegurar niveles de dignidad mínimos a las personas. Esta obra expone el estado actual de la teoría del derecho del trabajo. En sus capítulos se analizan los orígenes del derecho laboral, así como su fundamento filosófico, su visión finalista, sus caracteres, y su carácter de derecho de orden público. Este libro recoge las evoluciones contemporáneas de este Derecho, abordando materias como la ambivalencia funcional del derecho del trabajo, la nueva cuestión social, la discriminación laboral, las acciones positivas, la eficacia diagonal de los derechos fundamentales, entre otras. En esta quinta edición, se ha revisado completamente el libro, se ha agregado un capítulo sobre el fudamento filosófico del derecho del trabajo y, al igual que en ediciones anteriores, se ha enfatizado el relevente rol del método de principios en esta rama del derecho. En este punto, hemos agregado jurisprudencia principista emanada en los últimos años de nuestra Corte Suprema. El derecho del trabajo, al igual que la noción de dignidad o la de democracia, puede sufrir ataques, puede pasar por olvidos transitorios o momentos de oscuridad, donde las sociedades dejan de lado lo que nos convierte en humanos y nos diferencia como especie, pero siempre mantiene latente su vigencia y vuelve a renacer en períodos futuros, como ocurre en la actualidad en el debate acerca de la crisis del capitalismo salvaje.
