Studienarbeit aus dem Jahr 2011 im Fachbereich Politik - Grundlagen und Allgemeines, Note: 1,0, Albert-Ludwigs-Universität Freiburg (Seminar für Wissenschaftliche Politik), Veranstaltung: Gerechtigkeitstheorien, Sprache: Deutsch, Abstract: Auch heute sind wir noch immer auf der Suche nach der „wohlgeordneten Gesellschaft“ (Rawls 1998) und der ihr zugrundeliegenden Prinzipien. Moderne, westliche Demokratien beziehen sich auf ein durch die Aufklärung und den Humanismus bestimmtes Menschenbild. Der Mensch ist Zweck an sich selbst und nicht Mittel zum Zweck. Man darf ihn nicht ohne sein Einverständnis für andere Ziele opfern (Kant 1968). Jeder Mensch habe eine Menschenwürde. Dieser Kantische Grundsatz impliziert die Notwendigkeit von Rechten, die ihn in seiner Würde schützen und ihm die Freiheit ermöglichen seine Existenz als Selbstzweck zu gestalten. Dem nicht zu umgehenden Grundprinzip der unverletzlichen Wertigkeit und Würde des Einzelnen trägt auch die Suche nach Gerechtigkeit und der Form des richtigen Zusammenlebens Rechnung. Hierzu schreibt Honneth: „In der gesellschaftlichen Moderne ist die Forderung nach Gerechtigkeit öffentlich nur zu legitimieren, wenn in der einen oder anderen Weise auf die Autonomie des Einzelnen bezug genommen wird; nicht der Wille der Gemeinschaft, nicht die natürliche Ordnung, sondern die individuelle Freiheit bilden den normativen Grundstein aller Gerechtigkeitsvorstellung.“ (Honneth 2011) Gerechtigkeitstheorien befinden sich jedoch im Prozess und auch simultan gibt es sehr unterschiedliche Vorstellungen von Gerechtigkeit und damit auch Ansätze zur Ausgestaltung der menschlichen Gemeinwesen. Da nun aber, gemäß Honneth, die individuelle Freiheit den „normativen Grundstein“ aller Gerechtigkeitstheorien bildet, folgt logisch, dass die Vorstellung von Freiheit oder deren Verknüpfung mit den anderen, inherenten Gerechtigkeitsprinzipien divergiert. Es ergeben sich folgende, aus diesen Hypothesen resultierende Fragestellungen: (1) Wie sind moderne Gerechtigkeitstheorien aufgebaut und welche normativ-institutionelle Konsequenz haben sie? (2) Wie wird Freiheit interpretiert und wird ihr eine Vorrangstellung eingeräumt? (3) In welcher Verbindung steht Freiheit mit den anderen gerechtigkeitsimmanenten Prinzipien? Die Arbeit untersucht die Theorien von John Rawls, Robert Nozick, Philippe van Parijs und Axel Honneth hinsichtlich dieser Fragestellungen.
