Das europäische Mittelalter gilt allgemein als Urkundenzeitalter, doch auch in anderen vormodernen Kulturen sind Urkunden zahlreich überliefert. Nahezu überall in der mediävistischen Forschung spielen sie eine bedeutende Rolle. Urkunden werden nicht mehr nur als "Textspeicher" gesehen, sondern als Objekte, die in einem rituell definierten und symbolisch deutbaren Kommunikationsgeflecht stehen. Dabei wird dem oft hohen Grad an Bildlichkeit große Bedeutung zuerkannt. Urkunden dienten der Repräsentation von Rechtsstellung und Rang ihrer Aussteller, aber auch der Selbstdarstellung der Empfängerseite. Als serielle Quellen bieten sie Aufschlüsse nicht nur zur Herrschafts- oder Rechtsgeschichte, sondern auch zur vormodernen Sachkultur oder der Ideen-, Mentalitäts- und Frömmigkeitsgeschichte. Verstärkte Aufmerksamkeit findet neuerdings die abschriftliche Überlieferung, die neue Aufschlüsse über die Nutzung von Schriftlichkeit bietet, da Urkunden auch zu memorialen und historiographischen Zwecken kopiert wurden. Der Band soll sowohl den gewandelten Stand der Diplomatik deutlich machen, als auch die Möglichkeiten aufzeigen, die die Analyse von Urkunden für Fragestellungen etwa kultur- oder gesellschaftsgeschichtlicher Ausrichtung ermöglicht

Einleitung Untersucht man beispielsweise die Historie einer Gegend, so ist man zwangsläufig auf die, die betreffende Region Bezug nehmenden Urkunden angewiesen. Nun ist allerdings ein beachtlicher Anteil dieser erhaltenen Urkunden gefälscht oder verunechtet.1 Für den Historiker ist es nun von erheblicher Wichtigkeit, herauszufinden, welches der ihm vorliegenden Dokumente echt beziehungsweise unecht ist. Hier hat die Diplomatik, diesen Begriff prägte 1681 Jean Mabillon, ihren Schwerpunkt, denn sie ist die Wissenschaft von Urkunden und beschäftigt sich insbesondere mit der Urkundenkritik, dem discrimen veri ac falsi.2 Sie ist inhaltlich verbunden mit der Sphragistik, welche die Echtheit, Gestalt und Aussagekraft von Siegeln untersucht3, und in besonderem Maße mit der Paläographie, der Wissenschaft von alten Schriften.4 Mit Hilfe der Paläographie können Handschriften und Urkunden zeitlich und örtlich eingeordnet werden, zum Teil kann sogar der jeweilige Schreiber identifiziert werden.5 Der wichtigste Betrachtungsgegenstand der Urkundenforschung ist jedoch die Urkunde selbst: „Eine Urkunde ist ein in bestimmten Formen abgefasstes, beglaubigtes und daher verbindliches Schriftstück, das ein Rechtsgeschäft dokumentiert.“ 6 Ebenso als Urkunde gelten die „[...] im Verkehr des Herrschers mit seinen Beamten oder Unterthanen oder dieser untereinander erwachsenen Ausfertigungen, welche ein Rechtsgeschäft anordnen, vorbereiten, einleiten, oder auf seine Ausführung bezüglich sind.“7 Aus dieser Definition ergibt sich, dass die Diplomatiker eine große Menge an Dokumenten auf ihre Echtheit zu untersuchen hatten und haben. Die wichtigsten Merkmale einer Urkunde, die bei der Aufdeckung einer Fälschung von Bedeutung sind, sollen im Folgenden erläutert und beschrieben werden. Nach einer Darstellung der verschiedenen Urkundenarten werde ich mich mit der Frage nach den Aspekten auseinandersetzen, die ein Urkundenforscher beim discrimen veri ac falsi zu betrachten hat. Anschließend sollen die inneren Merkmale einer Urkunde, wie der Aufbau, die Sprache und der Stil erläutert werden und schließlich die äußeren Merkmale, wie Schreibstoff, Zeichen, Siegel und in besonderem Maße die Schrift herausgearbeitet werden.

Die vorliegende Untersuchung befasst sich mit dem Empfängereinfluss auf die Gestaltung päpstlicher Urkunden des 9. bis 11. Jahrhunderts. Entgegen der sonst zu beobachtenden Zentralisierung des Papsttums gibt es hier auffallende lokale Unterschiede in der Gestaltung von Papsturkunden, die anhand von 308 Beispielen – datierend von 819–1085 -- aus den Kirchenprovinzen Italiens und Kataloniens sowie Mainz, Köln, Trier, Reims, Lyon und Sens hinsichtlich Größe, Material, Schrift und graphischen Symbolen detailliert analysiert und statistisch ausgewertet werden. Während in Italien der Papstname besonders hervorgehoben wird, spielt in den Urkunden nördlich der Alpen die Größe des Dokuments eine entscheidende Rolle; in Lothringen sind beide Merkmale vereint. Diese Erkenntnisse erlauben Rückschlüsse auf die Autorität des apostolischen Stuhls in den verschiedenen Kirchenprovinzen. Das reichhaltige, auch durch Abbildungen repräsentierte Material stellt eine Sammlung dar, die auch in zukünftiger Forschung Verwendung finden wird.

Over the course of the twelfth century, the county of Champagne grew into one of the wealthiest and most important of French principalities, home to a large and established aristocracy, the site of international trade fairs, and a center for artistic, literary, and intellectual production. It had not always been this way, notes Theodore Evergates, who charts the ascent of Champagne under the rule of Count Henry the Liberal. Tutored in the liberal arts and mentored in the practice of lordship from an early age, Henry commanded the barons and knights of Champagne on the Second Crusade at twenty and succeeded as count of Champagne at twenty-five. Over the next three decades Henry immersed himself in the details of governance, most often in his newly built capital in Troyes, where he resolved disputes, confirmed nonlitigious transactions, and monitored the disposition of his fiefs. He was a powerful presence beyond the county as well, serving in King Louis VII's military ventures and on diplomatic missions to the papacy and the monarchs of England and Germany. Evergates presents a chronicle of the transformation of the lands east of Paris as well as a biography of one of the most engaging princes of twelfth-century France. Count Henry was celebrated for balancing the arts of governance with learning and for his generosity and inquisitive mind, but his enduring achievement, Evergates makes clear, was to transform the county of Champagne into a dynamic principality within the emerging French state.

Although it has a rich historiography, and from the late ninth century is rich in textual evidence, northern Iberia has barely featured in the great debates of early medieval European history of recent generations. Lying beyond the Frankish world, in a peninsula more than half controlled by Muslims, Spanish and Portuguese experience has seemed irrelevant to the Carolingian Empire and the political fragmentation (or realignment) that followed it. But Spain and Portugal shared the late Roman heritage which influenced much of western Europe in the early middle ages and by the tenth century records and practice in the Christian north still shared features with parts farther east. What is interesting, in the wider European context, is that some of the so-called characteristics of the Carolingian world – the public court, collective judgment – are as characteristic of the Iberian world. The suggestion that they disappeared in the Frankish world, to be replaced by 'private' mechanisms, has played a major role in debates about the changing nature of power in the central middle ages: what happened in judicial courts has been central to the grand narratives of Duby and successive historians, for they are a powerful lens into the very real issues of politics and power. Looking at the practice of judicial courts in Europe west of Frankia allows us to think again about the nature of the public; identifying all the records of that practice allows us to adjust the balance between monastic and lay activity. What these show is that peasants, like other lay people, used the courts to seek redress and gain advantages. Records were not entirely framed nor practice entirely dominated by ecclesiastical interests.
