Grounded in ethnographic and historiographic research and taking a cross-regional approach, this book explores the complex dynamics of similarity and difference, rapprochement and detachment, and divergence and competition between practitioners of Christianity, Islam and African religious traditions.Across Africa, Muslims, Christians, and practitioners of African religious traditions live in shared settings, demarcating themselves in opposition to one another and at times engaging in violent conflicts, but also being entangled in complex ways and showing unexpected similarities and mutual cross-overs. However, while encounters and entanglements of African religious traditions with either Islam or Christianity have long been a central research issue, the configuration as a whole has barely been taken into account, even though Muslims, Christians, and practitioners of African religious traditions have long co-existed - and still co-exist - more or less peacefully in many settings in Africa. This book presents an important ethnographic and theoretical advance in legal anthropological scholarship by interrogating customary law, customary courts and legal pluralism in sub-Saharan Africa. It highlights the vitality and continued relevance of customary justice at a time when customary courts have waned or even disappeared in many postcolonial African nations. Taking Botswana as a casestudy from in-depth fieldwork over a fifty-year period, the book shows, the ‘customary’ is robustly enduring, central to settling interpersonal disputes and constitutive of the local as well as the national public ethics. Customary law continues to be constitutionally protected, authorised by the country’s past as an authentic, viable legacy, from the British colonial period of indirect rule to the postcolonial state’s present development as a highly bureaucratised democracy. Along with a theoretical overview of the underlying issues for the anthropology and sociology of law, the book documents customary law as living law in the context of legal pluralism. It takes a legal realist approach and highlights the need to pay close attention to the lived experience of justice and its role in the production of legal subjectivities. The book will be valuable to Africanists but also, more broadly, to social scientists, social historians and socio-legal scholars with interests in law and social change, public ethics and personal morality, and the intersection of politics and judicial decision making.

Under the leadership of William F. P. Burton and James Salter, the Congo Evangelistic Mission (CEM) grew from a simple faith movement founded in 1915 into one of the most successful classical Pentecostal missions in Africa, today boasting more than one million members in the Democratic Republic of the Congo. Drawing on artifacts, images, documents, and interviews, David Maxwell examines the roles of missionaries and their African collaborators—the Luba-speaking peoples of southeast Katanga—in producing knowledge about Africa. Through the careful reconstruction of knowledge pathways, Maxwell brings into focus the role of Africans in shaping texts, collections, and images as well as in challenging and adapting Western-imported presuppositions and prejudices. Ultimately, Maxwell illustrates the mutually constitutive nature of discourses of identity in colonial Africa and reveals not only how the Luba shaped missionary research but also how these coproducers of knowledge constructed and critiqued custom and convened new ethnic communities. The aim of this book is to provide a way to do justice to an African language of faith. In systematic theology, anthropology and philosophy of religion, similar debates about how to interpret an African language of faith are ongoing. Trying to avoid the othering discourses of past generations, scholars are careful to take seriously what people in Africa say without portraying peoples beliefs as weird or backward. Yet, in their desperate attempts to avoid othering, these theologians, anthropologists and philosophers often painfully misconstrue the language of faith in Africa. Understanding the language of faith in Southern Africa is not an easy task. How should we take seriously the form of language that often seems so strange and different? I argue that, after African inculturation theology and black liberation theology, a better way to make sense of being a Christian in Southern Africa is to pay close attention to peoples language of faith. The way in which people speak of the spirit world or powers in Africa appears strange to outsiders, and the sense of community and the holistic worldview differentiates the African way of life from its Euro-American counterparts. When proper attention is paid to the use of concepts like spirit world, power, community and holism, language of faith in Southern Africa is neither as strange as it may seem, nor as romantic. By investigating these distinguishing concepts that colour language of faith in Southern Africa, this book contributes to future projects of both fellow theologians who try to construct a contemporary African theology and those who are interested in theology in Africa given the well-known southward shift of the centre of gravity of Christianity.
