This book's principal aim is to critically address the institutional and substantive legal issues resulting from European enlargement, chiefly those relating to the legal foundations on which the enlarged Union is being built. The accession of new Member States creates the potential for a stronger and more powerful Europe. Realising this potential, however, will depend on the ability of the EU to develop functional and effective governance structures, both at the European level and at the level of the individual Member States. While the acquis communautaire will ensure that formal laws in the new Member States will be aligned with those of existing members, the question remains as to how effective institutions will be in implementing changes, and what effects the imposed changes will have on the legitimacy of the new legal framework. This book, containing the work of leading scholars in law and social sciences, examines the current and future legal framework for EU governance, and the role that new members will - or will not - play in the creation of that framework, paying particular attention to the specific challenges membership in the EU poses to the acceding states of Central and Eastern Europe. Internal security is often hailed as a rapidly expanding area of European integration, with a growing number of strategies, policies and framework agreements in recent years. Yet actual cooperation, when viewed closely, proceeds at a halting pace – raising questions as to why cooperation appears so problematic. This book presents a novel, theoretically-informed way to understand internal security cooperation in Europe. The approach treats internal security as a "public good" requiring collective action amongst sovereign governments. All governments must contribute to the production of a public good; once produced, the public good benefits all governments. Fundamental obstacles to producing a public good thus arise, and can help explain the underlying difficulties facing European cooperation on internal security matters. The chapters in this book apply a public goods approach to different internal security issues, ranging from terrorism to border management, and from environmental security to natural disasters. Each study demonstrates how the various goals of internal security cooperation resemble different forms of public goods – and thus present different kinds of obstacles to effective cooperation. This book fills a theoretical gap in the literature on European internal security cooperation with a proven approach increasingly used in other scholarly fields. This book was published as a special issue of European Security.

Acclaimed as the "the most objective prosecutors in the world", the German prosecution service has long attracted the attention in the past of comparative law scholars. At first glance, the institutional position and statutory mandate of German prosecutors indicate that that reputation is well-deserved. Unfortunately, the introduction of charge-bargaining has opened the door to criticism that German prosecutors have abandoned their role of objective decision-makers. Using interview data collected from interviews with German prosecutors themselves as well as quantitative data, the book uses the actual voices of German prosecutors to show how real-world constraints, rather than changes in the law, undermine the ability of German prosecutors to objectively seek the truth. The book will take readers behind closed doors where prosecutors discuss case decisions and unveil the realities of practice. As a result, it will critically revise previous studies of German prosecution practices and offer readers a well-researched ethnographic analysis of actual German decision-making practices and the culture of the prosecution service. Unlike prosecutors in America's adversarial system, whom critics claim are driven by a "conviction-mentality" and gamesmanship, German prosecutors are institutionally positioned to function as (at least semi-)judicial officials dedicated to finding a case's objective truth. The book argues that, organizational incentives and norms, rather than the boundaries of the law determinately shapes how prosecutors investigate and prosecute crime in Germany.
