Der Gedanke, da das Recht im historischen Zusammenhange aus gelegt werden soll' war schen den Romern nicht fremd, sowohl bei Gaius als auch in den Digestenbruchstucken wimmelt es ja von historischen Hinweisen. Selbst die Glossatoren und Postglossatoren haben rechtsgeschichtliche Notizen verwertet und vollends konnen die groen Franzosen und die eleganten Niederlander des XVI., XVII. Und XVIII. Jahrhunderts geradezu als historische und philologische Juristen bezeichnet werden. Ebenso.haben die deutschen Publizisten bereits im XVII. Jahrhunderts historisch gearbeitet. Dasselbe gilt von den Englandern wohl schon seit Fortescue. Blackstone ist ein vollendeter Meister in der Kunst, das, was am geltenden Recht un verstandlieh scheint' historisch zu erklaren. Aber erst die historische J uristenschule hat die Rechtsgeschichte, die bisher doch nur um des besseren Verstandnisses des geltenden Rechts willen betrieben worden ist, zu einer selbstandigen Wissenschaft gemacht, zur Herrin im eigenen Hause. Fur den modernen Rechtshistoriker ist es gleichgultig, ob die Ergebnisse seiner Untersuchungen praktisch verwertbar sind, sie sind ihm nicht Mittel, sondern selbst Zweck. Und doch hat die Rechts geschichte, seit sie nicht mehr im Dienste der juristischen Dogmatik steht, dieser die unschatzbarsten Dienste geleistet; das beste, was die heutige Dogmatik an wissenschaftlichen Ergebnissen enthalt, verdankt sie der Befruchtung durch die Rechtsgeschichte. Die Bedeutung der Rechtsgeschichte fur die Rechtswissenschaft beruht aber nicht'so sehr darauf' da sie eine Geschichte, als darauf, da sie\eine reine Wissen schaft ist, fast die einzige Wissenschaft vom Rechte, die es Heiite gibt. Max Weber's Protestant Ethic is undoubtedly the most widely-read text in Western social theory of the last century. But is it really known? The proposition of this book is that it is not. Innumerable readers will "know" it for their own pedagogic and theoretical purposes, but properly historical grasp of the work's full range of meanings, of its place within the fertile culture of the German states before 1914, and within Max Weber's intellectual biography remains slight. The essays in this volume derive from the author's work in translating and commenting on the Protestant Ethic. They seek (first) to cast light on the range and extent of Weber's intellectual concerns when he was writing in 1904-05: not just English Puritanism, German theology, and capitalism, but also Herrschaft, Judaism, and the shape of Occidental history. This then serves to recapture the continuity and unity of Weber's intellectual development, so that once more we may see the Protestant Ethic at the centre of his oeuvre, the indispensable prelude to all his later work, rather than setting it apart in splendid but curiously lifeless isolation.
