English summary: The expansion of the Single European Market has resulted in a gradual liberalization of important public utility sectors, such as for example the postal system, the telecommunications and the broadcasting systems, the energy supply and public transport. Because of this, the problem of the 'correct' proportion of government to market has once again become of central importance. Comparing especially the French and the German systems, Johann-Christian Pielow examines the basic legal structures of public utilities and their typical features in the field of the electricity supply industry in different EC countries. He shows clearly how structural incongruities have arisen due to developments along different lines in each country and gives possible solutions for coping with areas of conflict in Community law. German description: Mit dem Ausbau des Europaischen Binnenmarktes schreitet die Liberalisierung wichtiger Sektoren der offentlichen Versorgung wie Post-, Telekommunikations- und Rundfunkwesen, Energieversorgung sowie offentlicher Personen- und Guterverkehr voran. This book examines the legacy of the 2003 ruling of the Court of Justice of the European Union in Altmark. This case changed the direction of how Services of General and Economic Interest (SGEI) should be funded in the EU against a background of liberalisation, and the need for efficiency and global competitiveness. The book examines the European Commission’s response to the Altmark ruling in the measures known as the ‘Altmark-Monti-Kroes Package’ and charts the review of this package from 2009 culminating in a new package of measures, known as the ‘Almunia Package’. The seemingly technocratic idea of a review of the ‘Altmark-Monti-Kroes Package’ could not have anticipated the demanding and changed economic and constitutional context of the EU in 2009. It is in this light that the authors in this book explore in great detail the different components of the new ‘Almunia Package’ of measures introduced in 2011-2012, offering a critical review and highlighting where the future direction of the regulation of SGEI may lead as the EU struggles in an economic climate of austerity to balance a new constitutional dimension of a ‘highly competitive social market economy’ with a modernisation agenda for the single market.

Die öffentliche Hand tritt vermehrt selbst als Bieter in Vergabeverfahren auf. Gegenstand ihres Interesses ist es, Leistungen der Daseinsvorsorge zu rekommunalisieren. Die Arbeit untersucht, ob und welchen vergaberechtlichen Bindungen die Öffentliche Hand dabei unterliegt. Ausgehend vom primär- und verfassungsvergaberechtlichen Rahmen wird die Bedeutung des Kartellvergaberechts, der Verordnung (EG) 1370/2007, des § 46 EnWG und des Haushaltsvergaberechts für den Aufgabenzugriff der Öffentlichen Hand entfaltet. Auf einer tieferliegenden Ebene wird untersucht, ob Primär- und Verfassungsrecht vergaberechtliche Privilegien der Öffentlichen Hand wie die Inhouse-Ausnahme begrenzen oder ob sie vielmehr einer vergabewettbewerblichen Strukturierung des binnenorganisatorischen Bereichs der Verwaltung entgegenstehen.
