Studienarbeit aus dem Jahr 2006 im Fachbereich BWL - Recht, Note: 1,3, Duale Hochschule Baden-Württemberg Mannheim, früher: Berufsakademie Mannheim, Veranstaltung: Ver- und Entsorgungswirtschaft, Sprache: Deutsch, Abstract: Seit Beginn der Liberalisierung des Strommarktes im Jahr 1998 sind massive Veränderungen in der Rechtslandschaft der Energiewirtschaft zu beobachten. Sowohl die Novellierung des Energiewirtschaftsgesetzes, die Einführung des Erneuerbare-Energien-Gesetzes, als auch das Kraft-Wärme-Kopplungs-Gesetz seien hier nur als die einschneidensten Beispiele genannt. Aus einem einstmals nationalen Markt erwuchs die Herausforderung für die zahlreichen deutschen Versorgungsunternehmen, nunmehr auf einem europäischen Markt bestehen zu müssen mit dem gleichzeitigen politischen Druck, die Strom- und Gaspreise drastisch zu senken. Sind die Preise für Strom nach der Liberalisierung in Deutschland erwartungsgemäß zunächst gefallen, so hat bis heute wieder ein Angleich auf das Preisniveau von vor 1998 stattgefunden. Nach Aussage von Michael Nickel (Leiter des VDEW-Bereichs "Markt und Daten") verminderten sich die Preise, welche die Haushalte für ihren Strombezug im Jahr 2000 zahlten im direkten Vergleich zu 1998 um knapp ein Fünftel. Seit dem sind die staatlichen Belastungen in Bezug auf den Strompreis stark gestiegen. Laut Michael Nickel sei der Strompreis für Haushalte ohne gestiegene Staatslasten 2004 noch um 16 Prozent günstiger als 1998. Ebenso führt er auf, dass seit der Liberalisierung die Staatslasten auf den Strompreis insgesamt verfünffacht wurden Da sich der von der Politik versprochene Wettbewerb auf dem Strom- und Gasmarkt nicht in Form einer hohen Wechselrate der Kunden einstellte und die Politik dies auf das blockierende Verhalten einiger Netzbetreiber zurückführt, steht nun der Energiewirtschaft mit dem so genannten "legal Unbundling", der gesellschaftsrechtlichen Trennung von Netz und Vertrieb, welche bis zum 30.06.2007 vollzogen werde

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

On the 30th of April 1993 the World Wide Web and its underlying technology was made freely available to use by anyone. Today over one billion people use the Internet, or every sixth person on the planet. A collective brain one might say is forming in front of our eyes growing with every new person entering three W’s into a web browser. While Ruggie aimed to search for, and investigate into, a fundamental transformation of the modern system of states, he emphasized that such an analysis would find a fruitful starting point in the [re]conceptualisation of territoriality. This paper will utilize Ruggie’s concept, by applying its analysis to the emerging and manifesting space-time implosion driven by the Internet and other communication technologies. Therefore, it is argued that Cyberspace provides a practical sphere to investigate into the unbundling of territoriality in a postmodern world. In the first section the impact on territoriality resulting from the emergence of the Cyberspace will be discussed. Ruggie’s model of differentiation between systems of rule and territory is applied to explain the transformation of territory in the postmodern era of Cyberspace. It is followed by an investigation into the consequences of Cyberspace on sovereignty. Showing that Cyberspace does indeed provide a new stage in Ruggie’s terms, facilitating an unbundling and relocation of sovereignty away from state territory. The third section discusses the implication of the virtual space on the rise and acceleration of globalisation. It is argued that globalisation, could not be perceived as a postmodern phenomenon without the Cyberspace revolution. The last part of the paper, proposes the need to rethink the notion of movement in the age of virtual and real spaces. Cyberspace allows ‘tourists’ in line with Bauman’s description to choose between virtual and real movement. The preceding discussion will finally lead to the conclusion that the conceptualisation of Cyberspace as one aspect responsible for the unbundling of territory provides an important explanatory insight into the transformation from modernity to postmodernity.
