This brief reference surveys the national policy of three representative African countries on the legal guardianship of children who are without parents or families. Focusing on the widely varying legal systems of Côte d’Ivoire, South Africa, and Uganda, the authors highlight guardianship as emblematic of the continent’s shortcomings in child protection laws. The book’s key objective is bridging the communal aspects of traditional African society with the global standards set forth by the Convention on the Rights of the Child and other international entities. To this end, the three frameworks discussed here are compared and their strengths and limitations evaluated as applied to child protection standards in terms of core guardianship issues: Holders of parental authority and responsibilities Appointment of a legal guardian Who qualifies as a legal guardian? Responsibilities of a legal guardian in relation to the child Termination of guardianships The primary audience for Perspectives on the Legal Guardianship of Children in Côte d'Ivoire, South Africa, and Uganda includes academics, researchers, and students in the fields of children’s rights, human rights, legal guardianship, and international law. It will also prove a useful reference for NGOs that focus on children’s rights, social workers and practitioners operating within the context of these three countries, professionals working within the African human rights system, and governmental law- and policymakers.

This book offers the first full examination of the legal role of public guardianship in 25 years, comparing current conditions to those when the last study was published in 1981. Public Guardianship: In the Best Interests of Incapacitated People? is written to advance public understanding of what happens to disabled and elderly adults when no family member or friend is available to be a caregiver or guardian should it become necessary. It is the first major study on this critically important issue since 1981. Conducted by experts in gerontology, social work, public policy, and public health, it finds that, although progress has been made, guardianship programs around the country still are hampered by limited staff and resources. Public Guardianship analyzes the full range of state statutes governing guardianship, including guardian eligibility, investigation, due process, rights, powers, costs, and monitoring. The authors report their case studies of public guardianship programs, marshaling and comparing field data from their surveys of stakeholders in ten states. The book concludes with a variety of recommendations for improving guardianship programs, including the authors' Model Public Guardian Act.

The Adult Guardianship Experiment written by Terry Carney and has been published by Federation Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 1997 with Law categories.

During the 1980s, Australia remade its 'adult guardianship' laws that governed people unable to manage their own affairs or property. The reforms embraced UN principles and took a common pattern with reformist North American and European countries - with one key exception. The rest of the world chose courts to administer the laws; Australia created specialist multi-disciplinary tribunals. This book compares the work of guardianship tribunals and courts and argues forcefully that Australia's adult guardianship experiment in popular justice is a success. Carney and Tait present work on the Australian tribunals in NSW and Victoria and compare them with overseas studies on courts (and the Family Court of Australia). On every measure tribunals outperform courts. They are more inclusive. They pay more attention to social context and functioning, and are better at incorporating the affected person into the hearing, striking an 'alliance' with them. Courts, by contrast, favour alliances with families and the medical profession. Even in areas where courts might be expected to perform better, they are less successful than the tribunals, collecting and testing evidence and avoiding unnecessary intervention.

Buzz Aldrin walked on the moon and received the Distinguished Flying Cross in the Korean War and the Presidential Medal of Freedom. At 88, his legacy is secure. On earth, it is another matter. “The problem with vulnerable elderly is that many, such as Buzz Aldrin, have not planned their ‘Golden Years.’ Whom do they really trust to make critical choices about finances, and essential healthcare decisions? One needs a qualified expert to deal these complex tasks. The lack of expert elderly planning can result in exploitation,” says author Robert T. Fertig. “[Guardianship Realities] offers a perfect picture of what guardianship [really is like], a work that showcases the authors extensive experience in dealing with the protection of the most vulnerable people in our society — children and the elderly. Readers are introduced to a wide range of case studies, insightful and well-meaning tips and advice, and a critical look at the legal system and its processes when it comes to Guardianship.” —Christian Sia for Readers’ Favorite (FIVE STAR RATING). “If you’re not accused of something, you’re probably not doing your job,” said Professional Guardian Fernando. Those insightful words came true in 2017 when Fernando was falsely accused of exploitation. Years later, a jury found Fernando NOT GUILTY. The lesson for ALL is this: Guardians, Trustees, DPOA and Proxys are vulnerable to accusations by patients and relatives of something, especially if they are conscientiously doing their job.
